Is Andrea Yates Insane?

Is Andrea Yates the mother who drowned her 5 children insane?Or did she knowingly murder her children?What should the punishment be if she is found guilty?

I believe that she is insane, and that she will recieve treatment now, and when she realizes what she has done, she will punish herself far beyond anything any of us could imagine doing to punish her.

You know... I don't even know where to begin on this topic. In my opinion... post partum depression can be bad, but not bad enough to kill all 5 of your children. I think she had some serious, serious problems, and should be held accountable for her children's deaths.

I have heard so many arguements about this woman... and to say the least, I am disgusted. When I saw her husband on the TV the day it was broadcast... he wasn't even crying... he didn't look like he'd even been crying at all. Something's just not right here... and I think she should have life in prison. Death penalty is too easy and gentle.

I am not trying to cause a stir in here... My sister has two little ones, and she had post partum, but not bad enough to kill them. Something should be done about this. I get sick to my stomach just thinking about it.

So, what do I think? I think the bitch knew what she was doing. She killed 5 children. One which she had to drag to the tub to drown, and he fought her all the way. She clearly premeditated the act by waiting till her husband left for work. She calmly called 911 AND SAID SHE DID IT! What the fuck is that? Crazy people don't know they are being bad. She prompted the insanity bit on her own.
As I said, most really crazy people don't know they are crazy.

I think the bitch should have to make kids clothes in a Taiwanese sweatshop while tied an moisture sensitive shock chair 24/7.

And you didn't think butt sweat could be used as a form of punishment?

Why is there even a trial? Lock her up in a loony cage for life. But no, Tx will sentence her to death and cost the taxpayers millions in appeals before she finally dies by lethal injection in 2022.

I can barely stomach even thinking about this crime.

She is sick and she needs to pay for what she did.

I blame her husband too. He knew that her PPD got worse with each pregnancy, yet he kept getting her pregnant. He left her alone with 5 children, home schooling them even!

the definition of insane is that you did not realise what you were doing............she doesnt fit that definition.

I may be mistaken, but I don't think that is correct. I think the legal test for insanity is not whether or not one knows what they are doing, but if they are capable of understanding if what they are doing is right or wrong.
Perhaps someone with more legal knowledge can clarity this for us.

I think the woman knew what she was doing. I think she knew it was wrong. I also think they should take her out back and quietly and quickly put a bullet in her brain.

I am not trying to interfere or be sided about who is right by any standards but that of the law as I am not a lawyer, but on Siren's behalf, I just thought I should tell you that Siren is a lawyer and has been for some time.

We have several regulars here how are... there are more than this, but here are the ones I know of, just so you know who to ask...

maybe they can give you some solid legal advice.

WD... She is not being tried for "Capital Murder". The death penalty is not an option for the jury.

My guess (that's all it is) is that she will receive a life sentence for each of the five children she killed. And I expect that while in prison she will receive treatment for her obvious mental problems. After about 10 or 15 years, someone will try to argue that she has recovered and should be released. In Texas, she won't be released.
