A Shenendehowa senior faces up to a year in jail for allegedly depicting fellow students and at least one teacher engaged in sexual activities in a pornographic story posted on an Internet site, investigators and prosecutors said Wednesday.

[Removed] was charged last month with second-degree aggravated harassment, a misdemeanor, after an underage female at Shenendehowa High School filed a complaint with the State Police. She allegedly identified herself as a character in the 40-page story.

"It was a story written on the Internet. It was explicit with sexual innuendo,'' Senior Investigator Curt Lohrey the State Police at Clifton Park said. "There was sufficient evidence for us to identify a complainant and to charge aggravated harassment.''

The Web site on which the story was posted has disclaimers about the sexual nature of the material found there. Many stories deal with mind control in which characters are forced to perform sexual acts. The stories sometimes give graphic detail.

Illegal or otherwise? Is he protected by the first amendment or is he a hooligan in need of disciplinary action? Might this be yet another stepping stone in the government's crusade for censorship?

Was this boy entitled to do what he did?
Was the girl entitled to do what she did?
Does he deserve jailtime?
What's right in this situation?
 
I think it depends on a lot of factors. How blatant the link was with the person(s) making the charges, for example.
 
damn km, that's a tough call. if the details they're using to identify the players include actual names i guess slander, character defamation and all that would come into play. if it just describes people in enough detail that the kids at school knew who they were then they probably won't have a prosecutable case.

They should both be charged with fraud & made an example of.

How would anybody know, other than the teachers, & surely they are professional enough not to let said portrayals influence their opinion of the girl, or talk about it, so no harm done.

You'd think the teachers would be wise enough not to tell anyone they read porn about highschool students.
 
The person who posted the story was 18 so he wasn't a minor. The article appears to say the girl read it and found herself to be very simular to a girl in the story.

So the only one who shouldn't have had anything to do with the site is the girl in question.

Without actual names in the story I don't see how they can charge the guy. Wouldn't it be all circumstancial?
 
I've never figured out the whole who's whose and hose bit.

The guy is 18 years old now, though she's not. Several story sites, including this one don't check. They think people should be accountable for themselves.

And this story could very well be posted here. There are no more free sites this large other than Lit and ASSTR. Hell, it could be someone we used to know on the boards.

But that's neither here nor there.

What's the right thing to do here?
 
The 'right' thing to do would be the guy who posted the story take it down from whatever site it is on. I don't know if that would be an admission of guilt but if the story is that questioned it would be smart for him to take it down. He shouldn't be charged with anything unless a real name is used. Anything else could be seen as... whats it called... artists license, or something like that.
 
Is there much of an option for what to do here at Lit (if that's what you're asking)? Laurel goes through a load of stories every night. There's no way that the site could go through and run a background check on every story to prevent this from happening.
 
I figured he was a minor, only because his attorney was seeking youthful offender status.

I think Minors who viewed the site should be held accountable.

I don't think a fantasy story, & it's fantasy if it's mind control, slanders anyone without names that are actual or thinly disguised. If it's a celebrity, then you can do it & name names. It's not as if anyone is asserting fact.

I don't think it's a crime to base a character on a real person.
