Y'all are mixing different concepts. Equal can mean all sorts of things, but "equal protection under the law" means that the government (private employer discrimination is a slightly different animal) cannot enact laws with the intent of treating certain classes of similarly-situated people differently. As a signigicant constitutional principle, it really has its roots in the 14th amendment and reconstruction when state governments tried to deprive newly freed states of fundamental privileges of citizenship.

Not every group is afforded protection under the clause. Speaking generally, it has to be a minority historically discriminated against by a majority, that is, it has to be a "protected class." Race and gender are the biggies. That said, reverse discrimination, too, can violate the clause.

Governments can enact laws that have the effect of treating protected classes differently. A court reviewing laws that appear to discriminate using standards based on the category.

"Strict scrutiny (if the law categorizes on the basis of race): the law is unconstitutional unless it is the 'least restrictive means' of serving a "compelling" government interest.

Intermediate scrutiny (if the law categorizes on the basis of sex): the law is unconstitutional unless it is 'substantially related' to an 'important' government interest. 'ex' generally has meant gender.
