Well, when you're not getting shut down by YT like they should be, why couldn't they get bolder? Doesn't seem like it matters who the author is they don't care. Howver, if Ohio is made aware of it and can drop a note on his home page, maybe his fans will swarm the video...which still may not matter.

In order to get YouTube involved a DMCA claim has to be made, which can only be done by the copyright holder. People commenting on the video isn't going to do anything, the channel owner will just ignore them or delete them. The whole point to the "email me if I am posting your content" is so that they can pull the video to avoid the DMCA strike.
