So, what was the real purpose behind Comey's conspiracy to appoint a Special Prosecutor that turns out to be a close personal friend, and what motivated Deputy Attorney General Rod Rosenstein to appoint a close friend of Comey's to end up investigating communications between Comey and Trump? Bob Mueller should have recused himself as soon as he laid eyes on the prepared testimony of Jim Comey.

"Something doesn’t seem right here. Comey manipulated the system into getting his friend appointed Special Counsel, and now that friend will be investigating matters in which Comey is a key witness. More than that, Comey’s own actions in leaking government property raise legal issues as to whether Comey himself violated the law.

Even assuming Mueller is able to separate his past with Comey from his present investigation, that relationship damages the whole purpose of having a Special Counsel who is completely independent in fact and appearance.

In a truly independent investigation, friends shouldn’t be investigating friends. Mueller should step aside to remove the taint on the Special Counsel investigation created by friend and witness James Comey."

I guess after all the outrage, from both teams, whether indicting Hillary before announcing he could not get a conviction out of the "non-political" Justice Department and then announcing he was reinvestigating right before he said, she's cleared again, the only question is, does the guy own a dog, because he might be a bit short on friends...

Bottom line is if Comey's notes become evidence in Mueller's investigation and Comey therefore becomes a witness, Mueller should recuse himself. That is if Comey's "notes" actually exist. Apparently, the only copy was turned over to the NYTs.
 
Most glaring in this little Machiavellian (and after firing) powerplay of Comey's is that while he was director he could have recommended a special counsel and he did not.

He manufactured this supposedly contemporaneous memo after the fact to justify doing something that he didn't recommend when he had the power to do so.

Now we have a special counsel to follow up and look into possibly the president obstructing justice on a probe into his activitied that did not exist.

Kabuki on steroids.

By the time Mueler and Comey talked, Mueler knew Trump's statement about being told he was not the target of any investigation was likely true. He knew about Comey's leaked memo, should have asked about whether the report of it's contents were accurate, whether it was actually written contemporaneously and should have requested that memo for his file.

As soon as Comey leaked that memo he had to know that it would be subpoenaed. If he destroyed that memo after leaking it knowing that it would be the object of a future subpoena he committed obstruction of justice.

He likely had to destroy it though, because the forensics would show that it was not contemporaneously written, making it highly suspect.

That's an interesting theory and it fits with the facts. Prior to Comey leaking his probably fabricated memo Trump warned him in public about leaking. Why would Trump suspect he was going to leak?

Trump hinting their were tapes made Comey stick closely to the facts of tge conversation. Nothing he claims Trump says puts Trump in actual jeopardy, and his own, subjective evaluation of those statements mean are not refutable, but carry no evidentiary weight.
