I don't think we should. The framers left that number open so that we could adjust the size of the court to fit the needs of the people. To fix the number of justices only creates a even more exalted prestige for those selected to the posts. Something akin to what the Pope enjoys, only it would be even more lavish and corrupt.

The last days of Rome were like that where the Senate failed to temper its own excesses and the people lost confidence in them. We cannot afford to lose confidence in the Supreme Court.

Those on the left who have been crying over Thomas, and now want to pack the court so all decisions come out "their way, " need to remember Rome and why it fell. Because sure as God made Huns and barbarians, it'll happen here if the Left gets their wish.

I missed the bad history in this post. Augustus Caesar seized power from the moribund Senate in 27 BC. The Western Empire didn't fall until 500 years later. The Eastern Empire lasted until Constantinople was overrun by the Turks in 1453 AD

We should certainly guard against losing our democracy to a would-be dictator, but the barbarians are not at the gates.

The job of the SCOTUS is to do exactly that. A whiny trial court judge complaining about it is only adding to the basis for an appeal of his decisions based on him inserting his personal beliefs into the case.

What we DO need is a Constitutional Amendment setting in stone the size of the Supreme Court, and maybe, just maybe, it's time for a Constitutional Convention to introduce a few other amendments. Clarify the 2nd rather better, create a few new states and reborder a few existing ones, or at least a concrete process for doing so. And maybe downsizing and stripping away big big chunks of the Federal Government.

While -- on the other hand -- I fuly agree with you on the need for a new Constitutional Convention. Plus on reforming big chunks as you say of the Federal goverment.

What it would do is put a stop to the Democrats current fixation on stacking the court, which would be stupid, be cause the next GOP President would just add more and stack it the other way, and so on and son until until the whole thing became to unwieldy to function and disintegrates, which is likely the objective in any case, because its pretty obvious Democrats hate the Constitution because it restricts them from doing whatever they want, and they want to stack SCOTUS for the same reason.

The Democratic Party these days is inherently anti-Constitutional and actively do not wish for, and actively work against, a Constitutional Republican form of Govt. We really need to lock things down so they have not a hope. The list of whats needed is long. Things like depoliticizing the judicial system to start with and god alone knows how you do that. You have to start with the law schools and work thru.....

LOL. And THIS is a prime example of the ridiculousness of the Democrat's hyperbolic attempts to destroy the judicial system. Presidents nominate a judge for SCOTUS to replace one who dies or retires. The President cannot "stack" the court. He nominates a successor and the Senate confirms or not. We could equally say Democrat Presidents stacked the court with left wing judges for decades. But we don't. Because the accepted practice is that each President nominates judge(s) to succeed those who die. Or retire. Now we have a SCOTUS with a conservative bent, all of a sudden Democrats want to change the system because it doesn't favor them.

Tough. Fucking. Shit. You just illustrated in one sentence everything that is detestable and reprehensible about Democrats, and why we want to roll back just about every piece of legislation and regulation and change Democrats have made. It's almost amusing if it wasn't so dangerous. You really have no idea of the ultimate consequences of what you'd like to do, do you?
