what confuses me is the system over here where you don't go directly to prison once sentenced, but get to walk around, doing your thang, for months.![]()
Do you know what an appeal is?
An appeal is where you ask a higher court to review your trial/sentencing for errors by the court. It can take YEARS to get through your appeal process.
Isn't it a bit unfair if you have to go immediately to jail and serve your time before the appeals court says that the trial court made major mistake and finds you not guilty?
Under our 8th Amendment we are prohibited from imposing "cruel and unusual punishment". Requiring someone to serve excessive or improperly imposed jail time would fall under that category. Thus, the convicted are occasionally allowed to remain free while their appeal is pending. Not always, but occasionally.
There is enough doubt about the irregularities in the Stone case affecting the outcome that remanding him immediately into custody would be unfair.
