If it were possible to evolve "towards better luck," which it isn't; no more than it is possible to evolve toward paranormal/psychic abilities, because they do not exist and are not physically possible.

But you dont know that, and besides, lawyers invent all kinds of artifical stuff they treat as real.
No lawyer of my acquaintance, ever, would confuse the "reality" of a legal concept with the purported reality of a physical phenomenon.
