Will Derek Chauvin Be Released From Jail?

It's all right there in the Coroner's Report.

Revisiting the quote you lifted out of the report. First of all that was added to the report after the fact and it is alleged that that addition was done so under duress from the prosecution. Be that as it may, the problem remains that that quote is an OPINION rendered by the Coroner and OPINIONS are subjective. There is NO science in the report that supports that opinion, none. And just as you jumped on it as being substantive I can imagine a jury being swayed on an emotionally charged case.

Further, the police training officer perjured herself when testifying that that from of restraint ISN'T taught in the academy. That is an out and out lie, it is a basic method of controlling a resisting arrestee.

Polyshitforbrains points out that the verdict survived appeal. Of course it did. Without glaring errors in the trial no appellate court is going to overturn jury's verdict. It is not the appellate courts job to retry the case on evidence.
The report states that he was killed by force.

The coroner reiterated that during his testimony.

Further testing during appeals confirmed this.

He was convicted and properly sentenced.
 
I saw the same video. I saw a man agitated, resisting, and possibly under the influence, being restrained with what appeared to be a standard knee hold applied to the shoulder and lower neck. I didn't recognize what I saw as murder. There is this emerging as well:

What we know: Chauvin’s legal team filed a motion on Dec. 13 requesting to re-examine evidence, including fluid and heart samples, as part of a claim that Chauvin kneeling on Floyd’s neck was not what killed him, but rather a heart condition.

Chauvin claims he received "ineffective assistance of counsel" arguing in part that a forensic pathologist contacted his lawyer prior to his federal indictment, suggesting Floyd may have died from a heart condition.

The pathologist suggested the examination and testing of preserved samples taken during Floyd’s autopsy would support that opinion. However, Chauvin claims his lawyer didn't discuss the pathologists' opinion with him, or request further testing of the autopsy samples.

In a decision on Monday, a federal judge granted the motion allowing Chauvin’s legal team to analyze the samples and conduct specific tests.

What they’re saying: "Given the significant nature of the criminal case that Mr. Chauvin was convicted of, and given that the discovery that Mr. Chauvin seeks could support Dr. Schaetzel’s opinion of how Mr. Floyd died, the Court finds that there is good cause to allow Mr. Chauvin to take the discovery that he seeks. Accordingly, the Court grants Mr. Chauvin’s motion," the court document reads.

Remember the standard is "beyond a reasonable doubt." If the findings uphold the verdict, then have him serve out his time.

You keep saying this, but did the Jury see what's now being alleged?
Was the alleged worthy of the jury to see? Did someone on the defense not do their job?

Yes. It was alleged at the time and defense counsel had an opportunity to challenge the testimony.on appeal.
In his federal appeal, Chauvin argued that his trial attorney failed to inform him about a forensic pathologist who questioned Chauvin's role in Floyd's death and also failed to seek testing of heart tissue samples.

Chauvin killed Floyd.

Floyd was in custody at the time of his death. Floyd was complaining that he couldn't breathe. Chauvin ignored his complaints. Floyd died.

Those are the relevant facts. The physical cause of death isn't all that relevant because at the time Floyd died, he was in custody and those responsible for his wellbeing ignored his pleas for help.

This is called depraved indifference and it was clearly documented on video. The Coronor's report, who added what/when/why, scumbag, drugs, resisting arrest, and the rest are all political theater and finger pointing. Floyd died because Chauvin had a duty of care for Floyd's welfare and yet did nothing except threaten the crowd of onlookers while ensuring that Floyd couldn't receive the care he needed to save his life. It was cold, calculated, and ended exactly how Chauvin wanted it to turn out.

Floyd was a scumbag of the first order. There is no doubt of that but there is also no doubt that Chauvin killed him. The entire sorry deed was caught on video for the entire world to see. It wasn't Floyd's skin color, his criminal history, drugs, heart condition, whatever the fuck other thing you want to throw into the mix, it was Chauvin not giving a fuck if Floyd lived or died and then actively preventing Floyd from receiving medical assistance.

It's that "actively preventing" part which would have made me, if I were the DA, charge Chauvin with murder and I'd have sought the death penalty. His compariots would have been charged as accessories to murder.

You can have a different opinion on the degree of depravity Chauvin showed, but you cannot reasonably state that Chauvin is innocent. The video disproves any such position.
 
You can hate Floyd all you want for his behavior. That doesn't mean he deserved to die. Chauvin's actions led to his death and he was tried and convicted.

Assistant Minneapolis Police Chief Katie Blackwell made the classic mistake of suing a truth teller for defamation, namely the intrepid Liz Collin of Alpha News. In her book,
"They're Lying: The Media, The Left, And The Death of George Floyd," and in her documentary, "The Fall of Minneapolis," Collin claimed Blackwell may have lied on the witness stand by stating that Derek Chauvin's use of force on George Floyd in 2020 was improvised and unauthorized.

In Minneapolis, Blackwell had every reason to expect a stacked deck, but Collin held all the cards. The court filings of her and her co-defendants, as reported by the Minnesota Star Tribune, "included sworn declarations from 33 former MPD officers who served with Blackwell and an officer still on staff. Those officers alleged that the restraint used by Chauvin on Floyd was part of department training." Fourteen of those went so far as to allege "Blackwell committed perjury when she testified at Chauvin's criminal trial."

In a stinging 58-page order, Hennepin County Judge Edward Wahl soundly rejected Blackwell's suit. Collin and her co-defendants, he wrote, "hit every legal standard necessary to avoid the lawsuit going to trial – including that their questioning of whether Blackwell lied on the witness stand met the legal standard of 'substantial truth.'"

Last month, Wahl dismissed Blackwell's lawsuit and ordered her to pay the defendants $75,000 in attorney fees. This past week, Blackwell accepted the dismissal of her defamation suit and agreed to pay the $75,000. This story has not gotten nearly the attention it deserves.
