Biden prepares to strip college students of due process rights

It’s worth reminding people that if President Joe Biden were compelled to live by the standards he intends to institute for college students accused of sexual misconduct, he would be presumed guilty of rape, denied any legitimate opportunity to refute Tara Reade’s charges and tossed from office in disgrace.

The New York Times reports this week that Biden’s Kafkaesque “White House Gender Policy Council” is “beginning his promised effort to dismantle Trump-era rules on sexual misconduct that afforded greater protections to students accused of assault.” The subhead informs us that, “The Biden administration will examine regulations by Betsy DeVos that gave the force of law to rules that granted more due process rights to students accused of sexual assault.”

The most disingenuous word here — though the piece is brimming with them — is “more.” History did not begin in 2015, and former education secretary Betsy DeVos did not invent more due process rights in Title IX; she simply reinstated time-honored fundamental due process rights that have guided justice systems in the liberal world for hundreds of years. The Constitution says — twice — that no citizen shall be arbitrarily “deprived of life, liberty or property without due process of law.” No means no.

It was only in 2011 that the Obama administration instituted fewer due process rights through the force of law, denying the accused the ability to question accusers, the right to review the allegations and evidence presented by their accuser, the right to present exculpatory evidence, and the right to call witnesses. Basically, the right to mount a defense.

Th Op is inflammatory and inaccurate.

What is happening is a group of students living under the Trump/DeVox rules are openly discussing the failings of the Trump/Devos policies. The game of make-pretend that this only goes back to Obama-era rulemaking is a canard.

The "rights" in question include the right to a hearing with cross-examination through a third party, the ability for students to see all the evidence compiled and the presumption of innocence at the outset of an investigation. These are not being challenged for removal, they are being challenged as to their implementation.

The group making the push "Know Your IX also says the Education Department needs to take steps to stop schools from punishing students who report sexual assault, that states should amend laws to prevent students from facing defamation suits for filing Title IX complaints, and that schools should start releasing data annually on outcomes of student disciplinary cases involving sexual misconduct — none of which were addressed by the Trump administration."

Also Know Your IX doesn’t oppose keeping certain aspects of the regulation, such as an impartial and “thoroughly trained” panel making decisions on whether a student violated a school’s sexual misconduct policy. The group also supports cross-examinations done through third parties.

So preventing reprisals and efforts to bully and silence victims while keeping the rights of the accused in balance is NOT the same thing as " stripping college students of due process rights".

This is especially bad news for Brigham Young university, which used to expel rape victims if they REPORTED being sexually assaulted.

(Mormon women are taught to fight unto death to keep the sanctity of their maidenhoods unsullied).

Do you recall the Duke Lacrosse players accused of raping an escort? They got kicked out of school and then it turns out to be a big lie. And Duke spent millions on this false claim. I have two daughters in college and they know to protect themselves and if something happens call the police. A university is ill equipped to handle legal issues such as this and a kangaroo court is not a place try such a case.

And in the end they got millions of dollars each in settlements. Not to mention the fact that you have to reach back fourteen years for your example speaks volumes.
 
I didn't say it did. My point is justice eventually prevailed in that case. And it doesn't change the fact that false accusations like that are extremely rare.

Says who? You? False allegations are made all the time in all kinds of things. It's the idiots in the media that compound the problem. George Floyd died of feyntenal poisoning, not a knee on the neck.....imaging had that been accurately reported from the beginning.......

BTW did you read either of the two autopsy reports?
