I think one takes a truly objective view they would see a bunch of partisans who hate Hate HATE it when the other team has the authority to decide what to enforce and what to let slide as low priority.

I assumed they were not really arguing the overall merits, just the immediacy of the relief requested.

It looks like dissent addressed the merits and denial ignored the disparate treatment, made gratuitous assertions about the asymptomatic carrier boogeyman and denied because they felt it not exigent.

So apparantly, the Bill of Rights does not apply so long as you declare an emergency and suspend rights "just in case" it helps and can do so over an indefinite period of time.

The State of California has had plenty of time to engage in actual scientific study to demonstrate their exigent circumstances for infringing on the free exercise of religion and they were not required to meet that burden. Why does the burden shift to the oppressed?

The *number* of EOs is not a useful metric.

It isn't just a concern that executive orders are being issued, some orders are very defensible, and demonstrably beneficial in non controversial ways. At issue is the what action individual executive orders have and whether a particular order overstepped constitutional constraints on executive power or usurped congressional authority.

That problem is not a one-way proposition. Contrary to constitutional intent most "law" and regulatory authority is enacted by fiat through the executive branch. Sometimes Presidents just seized the authority over Congress' mild, minority objections, but more often than not by Congress abdicating their responsibility to flesh out legislation and conflict oversight.

I'm not aware of any president other than Obama saying the quiet part out loud that I'm going to use my pen and my phone's to specifically conch ravine Congress is authorization permission and intent. I'm going to ask you serve their authority because I can. He got slapped down by the Supreme Court for DACA and he should have been rejected on DACA. His unlawful orders on the ACA should have been struck down.

Trump's latest adventuring is likely not constitutional will definitely be challenged in court if he bothers to follow through on it and should be struck down.

I am not sure why he does not enjoy immunity from criticism for his historic achievement as the first reality TV star and producer to be elected POTUS.

An honest liberal with respect for plain-language might be better. It's tough to think about the law from a perspective of fidelity to appropriate principles theater than getting rulings that break in ways that favor policies you like.

I like Heller. I'm unconvinced it is correct. I would prefer a parallel universe where a liberal court ruled the other way, and did so by threading the needle by constraining the 14th. I do not believe the 14th was intended to incorporate any other amendment than itself. I think Col. Hogan convincingly refuted my position, but I still think the states should be able to decide on a lot of matters.

Stiff like that.

As I pointed out above, although there's a lot of what about isn't to go around there's even more false equivalencies on that issue.

Trump's going to have to get his Mussolini on if he's ever going to best Obama's DACA EO. It's truly a standing though that one president can use his pain in phone to an act a clearly unconstitutional EO which cannot be undone by the next president in a constitutional matter with the same pain in phone.

We really do need one set of rules whether that happens to benefit my guy the way I like it or not.
