a toxicology report on Ward revealed that he had marijuana in his system at the time of the accident.

I would expect that Stewart will quietly give some money to the family without acknowledging any culpability, simply to assuage some of his angst over the incident.
He couldn't do that prior to the grand jury exonerating him, lest it appear he was trying to buy his way out of the controversy.
The payment information will be leaked and WhoGivesaRippaDoo will be back squawking that the money shows conscientiousness of guilt.

Oh i would say that there was a clear winner!
Those videos were examined in detail. They were enhanced. They were run through programs that allow the frames to be isolated. They were run at 75, 50 and 25 percent speed. They were overlaid with grids and data and they were pretty important piece of the evidence here.
The videos did not demonstrate any aberrational driving by Tony Stewart until the point of impact with Kevin Ward, at which his vehicle veered to the right, up the track as a result of the collision. Prior to that his course was pretty straight.
Our son got out of his car during caution while the race was suspended. All the other vehicles were reducing speed and not accelerating, except for Tony Stewart, who intentionally tried to intimidate Kevin by accelerating and sliding his car toward him, causing the tragedy.
The focus should be on the actions of Mr. Stewart and not my son.
...were not considering whether anybody else was at fault. However, I am sure from their deliberations and discussions that the fact that Kevin Ward was observed running basically down two thirds of the track, into a hot track, into the middle of other cars that were racing, played a big, big factor in their decision.
Realistically, I think judgment is probably the most important factor in this case.
Evidently, it was video and Stewart's statements to investigators immediately after the incident which easily swayed the grand jurors, his statements never veering from what the jurors actually saw on video...
...according to Ontario County District Attorney Michael Tantillo, who brought the case before the Grand Jury:
It's long been guessed at by many that Ward, Jr. was actually trying to take a swing/jab at Stewart, first avoiding being hit by the right front, then stepping further in to take his swing/jab, but then immediately sucked-in to, and under, the right rear. With today's revelation that Ward, Jr., was stoned at the time of his death, this theory now almost becomes gospel to some.
Of the 23 grand jurors, only 12 had to vote for either second degree manslaughter or criminally negligent homicide for Stewart to be charge with either offense.
The word is that Smoke, within literally hours of the incident, reached out to the Ward family with the offer of any help he could provide (including footing the funeral bill); he was basically told to get screwed...
...that attitude continues today with the release of a statement by Ward, Jr.'s mom, underlining that the "matter is not at rest":
The fact is that the entire focus has been on the actions of Stewart...
...and there is not one ounce of evidence that incriminates his actions that night, let alone supports in any practical way her emotional charge that Stewart "intentionally tried to intimidate Kevin by accelerating and sliding his car toward him, causing the tragedy."
In fact, District Attorney Tantillo, pinpointed where responsibility lays for what happened that night; the grand jurors, he said:
I wouldn't be surprised now if Stewart again reaches out to the Ward family, but he won't pay them a cent of the kind of vengeful blood money they're evidently after if they go civil and, with the evidence presented to the Grand Jury - including the fact that Ward, Jr. was so irresponsibly high - I can't see a jury favoring them in any way...
...and it's a good thing for them that Stewart is a good, honest man because he won't counter sue them for the obvious defamation of character and slander course they're still on.
If it was anyone of us vehicular manslaughter would have been the charge....eventually, because we wouldn't have had it decided so quickly.
At least it's not as bad as Donte Stallworth playing in the NFL after he killed someone drunk driving.
