question on little jesica (serious replies only please)

This discussion has been talked about several times since Jesica was taken off life support about a week ago. I don't think I need to go into the whole story again. anyone who follows the news knows what happened to this little girl and so forth.

I just got a few things to ponder over and maybe some other people that were following this tragic thing that happened.. can also shed some light on this topic

1) I am hearing 2 things regarding the doctor that had fumbled this whole procedure. I saw him at the press conference last week and he was crying and saying how steps will be taken and this will never happen again and yada yada yada (meaning, it sounded like they didn't take any action against him losing his licence or him getting canned) .. and then I am hearing from different people that he might lose his licence and Duke University doesn't wanna lose money over this whole ordeal so they will just let him go. now.. who is right on that one?

2) Jesica was an illegal alien. does that mean that Duke University can't get sued? someone told me that because she was an illegal.. Duke University won't suffer that much of a loss

These are just 2 things off the top of my head that has been swarming around on message boards and I thought I would get another opinion

I thought they brought her here from Mexico specifically to bring her to Duke after they'd originally snuck her in. Maybe I just read it wrong.
 
judging from my experience with working with malpractice insurance, the surgeon, will probably keep his license, his license would need to be reported to his state board before any such action will be taken, which may or may not happen. If it is, what happens to his license depends on several factors, what state he's licensed in (some states are more stringent than others), his claims history, and if he has ever had a complaint filed against his license before. As far as liability, regardless of whether they are illegal aliens or not, Duke, the surgeon, the nurses, the surgical assistants, down to the very person that delivered the organ are facing a huge lawsuit that could possibly reach in the millions. Is this the worst case I've ever seen? Sad to say but it isn't, but because this case has been publicized so much, the claimants will probably get a large settlement.

Medical review boards don't happen overnight. When a doctor screws up there is a complete hearing process just like in a criminal case. The results of any investigation and decision by the licensing board aren't likely to be known for several months at a minumum.

Duke Univ. however, isn't the agency that issued his medical licence. His licence to practice medicine and his job are two seperate (although probably related) issues.

There is nothing that prevents an illegal alien (if she even was..) from suing. Her immigration status in this country had nothing to do with the decision to use the organs for the 1st transplant.

Whether the family can find someone to represent them in a suit is another can of worms there though.
