Apparently Hunter's lawyer is insisting that the diversion part of the plea agreement is still in effect.
Personally I think his lawyer is scrambling and trying to figure out a way to avoid looking like a loser because there's a problem with this entire line of reasoning.

The problem here is that Hunter was just indicted again for the tax fraud stuff. Some people believe that this indictment was done so that he could assert his 5th Amendment rights at his upcoming deposition to avoid answering questions about his dad getting paid off.
But...
If the plea deal is still in effect as his lawyer claims, then he WAIVED that right.
