The Grand Jury finding still stand, but the prosecution had to rush to court to file the case because the statute of limitations was about to run out....that's why they couldn't wait to get Lindsey Halligan confirmed.

The statute of limitations has now expired, and in theory Comey cannot be prosecuted because the prosecution has not brought a valid Grand Jury true bill to trial within the proscribed time limits.

I'm pretty sure that the government will claim some sort right to a "do-over" but that's not a certainty at this point. I'm equally certain Lit's Aspy Attorney will twist the findings of the court's dismissal as evidence that the government "must" file for a re-trial "by law".

Derpy is whining on BB's MAGAt thread of the same topic. Comey is home free, but Derpy apparently has a theory that the statute of limitations does not apply if a DOJ prosecutor is taking orders from the Pig.

These MAGAts have a hard time following the rules, both on Lit and in real life. They cry a lot and make fools of themselves.

U.S. District Judge Cameron Currie said that she agreed with Comey, who moved to dismiss the case on the grounds that Halligan's appointment was illegal.

"Because Ms. Halligan had no lawful authority to present the indictment, I will grant Mr. Comey’s motion and dismiss the indictment," Currie wrote in finding that Halligan lacked the authority to present a case to a grand jury.

"All actions flowing from Ms. Halligan’s defective appointment, including securing and signing Mr. Comey’s indictment, were unlawful exercises of executive power and are hereby set aside," the judge wrote, describing the insurance lawyer as "a former White House aide with no prior prosecutorial experience."

She issued a separate, similar ruling dismissing the James case.

“This case presents the unique, if not unprecedented, situation where an unconstitutionally appointed prosecutor, 'exercising power [she] did not lawfully possess,’… acted alone in conducting a grand jury proceeding and securing an indictment,” the ruling said.

I believe the judge was actually too generous in the wording of the dismissal, as they were clearly malicious, politically motivated prosecutions with zero legitimacy based on the facts & the law.

The judge seemed to be trying to protect "the justice system" as a whole by squashing the prosecutions based on a "technicality", rather than corrupt intent.
