California lt. governor seeks to remove Trump from primary ballot

Following the ruling by Colorado's Supreme Court that said Donald Trump is ineligible for the state's presidential primary, California's lieutenant governor is calling to have him removed from the ballot here.

"Based on the Colorado Supreme Court's ruling… I urge you to explore every legal option to remove former President Donald Trump from California's 2024 presidential primary ballot," Kounalakis wrote in a letter to Secretary of State Shirley Weber that was released Wednesday.

"California must stand on the right side of history," Kounalakis's letter said. "The constitution is clear: you must be 35 years old and not be an insurrectionist" to be president of the United States.

Time is short to make a decision. Weber must announce the certified list of candidates on Dec. 28. The California presidential primary is March 5, 2024.

Trump's team criticized the Colorado ruling and said it would appeal to the Supreme Court.

"This ruling, issued by the Colorado Supreme Court, attacks the very heart of this nation’s democracy. It will not stand, and we trust that the Supreme Court will reverse this unconstitutional order," Trump legal spokeswoman Alina Habba said Tuesday.
 
Honestly, if I were a Republican, I'm not sure I'd want my money being spent in California anyway. He's got as much chance there as the Dems do in Wyoming.

This lady also said “the Constitution is clear...” To qualify for the presidency “you have to be 40 years old…” 😂

As a practical matter, Trump will be on the March 5th ballot in CA, and as others have correctly noted, it won’t mean a thing as far as the outcome of the GOP nominee selection process.

So I think I have this correct. If Trump wins, but his eligibility is challenged and he is found to be ineligible by the 14th amendment, it would then be his VP who would be sworn in?

My point with regard to the Lt. Governor of CA is that her letter to the Secretary of State is pointless. Trump’s name will be on the 3/5 ballot in CA, and the primary results in that deep blue state will have no impact on who the GOP selects as their presidential nominee.

No, I don’t know the answer to that far-fetched hypothetical question but did see an OpEd this morning in the WSJ written by someone who thinks they do know the answer to that. It’s paywalled but I can post a few snippets to give you the jist of their argument if you are interested. I have no pov on that question.

It's not far fetched, given how slowly court rulings move at, it could very well occur. ( it might even be after Trump is sworn in, but that would be really stretching the hypothetical)
