I would actually be surprised if the corrupt right wing “justices” on the Supreme Court ultimately find the lipstick on this pig of a remedy is “good enough”.

Nonsense. In Alabama more than any other state (except maybe Mississippi), it's still all about racial resentment. The only way Democrats could be serious contenders there would be if they returned to the bad old days of embracing white racism. If that's the option, I'd rather lose!

No, I don’t have an issue with how civil disputes are adjudicated. Redistricting maps are frequently challenged in court. Sometimes the plaintiffs win and sometimes the defendants win. Alabama map was challenged and in court. The state lost and was ordered to draw new maps. They’ve done that and they believe the new map is compliant. Name calling is a reflection of your frustration. If it brings you comfort, bless you.

I don't think so. They are defying the court. That's going to piss off all of them whether they are a conservative or liberal.

Dems are playing the race card because the dumbasses in the state legislature are still being racially prejudiced. They gerrymandered the districts to remove any chance black voters had to elect the representative they wanted. Yeah, you can claim they did it to remove any chance of a Democrat being elected, but they still screwed black voters in the process. The court has a conservative majority. The Dems did take it to the court but the conservative SCOTUS found in their favor.

And that last sentence of your post is bullshit. If it is true then tweaking the districts PER COURT ORDER shouldn't make a difference huh? I have not read the full 112 page decision, nor have I studied the old and new maps. Even if I had, I’m not a lawyer. From what I’ve read in the news articles, Alabama needed a second majority Black district “or something quite close to it.” The state legislature and governor believe the new map is in compliance. Democrats believe it’s not. It’s being challenged and there’s a hearing next month. That’s how due process works and civil disputes get resolved. I have no idea what the outcome will be. I’ve got no issue with the SCOTUS decision and no issue with the state of Alabama’s effort to comply. Let the chips fall where they may.

And they will fall back on , you didn’t make two.. and even when you only made one, you reduced minority majority in the one… not going to pass the “close to it” test.

When did any of these politicians testify under oath that they believe what they’re doing is legal?

Why do we have to let chips fall? Why not just robustly follow the court order?

Perhaps the court will impose one?

There was a decision out of either Georgia or S. Carolina just recently which states that the courts cannot draw districts themselves or designate someone to do it because that it a Constitutional provision granted to the States and not the Fed government or the courts.

So the court can't redraw the districts nor can they appoint a special master to do it.

The interesting extension of the opinion is that the courts really don't have jurisdiction to determine if the boundaries are "lawful" or not since, again, that's something which the individual States have the sole authority to determine. Which means that if a State wishes it's Congressional Districts to be discriminatory, there's not a lot the courts can do about it.

Then there's the fact that the courts can't "order" the State legislature to act or enact legislation under the Separation of Powers doctrine. The courts are limited to jurisdiction over existing laws/legislation.

Basically, if a State wishes to tell the court to go pound sand and they're going to stand by their redistricting maps, there's not a lot the court can do about it. They can't even send in the US Marshal to enforce their order because the Marshal can't do anything inside the State House and, if he tries, he's subject to arrest for interfering with a legislative session.


The only available possibility here is if there's a State law which requires what the court is ordering. I don't think there is, but I'm not conversant in that State's election/redistricting laws.

Maybe they don't want outsiders telling them what to do.

The answer I keep coming back to is a constitutional amendment for independent redistricting commissions. That would take national consensus. We're not anywhere close to that yet. And the parties would eventually or immediately find ways to influence or hack the commissions.

Gotta admit, repubs are way better at gerrymandering than dems. Voters scare repubs
