Incorrect.
The law allows for the direct examination of the jurors to determine if they have such undesirable qualities. This is called Voir Dire.
Upon a satisfactory showing that the prospective jury does not, they are presented the evidence of the offense. The color of the skin of either the defendant or the victim should not be a consideration in how heinous the offense is. If the offense is proven to have been committed, then EVERYONE who commits the same offense should be treated equally no matter the skin color/gender or the color skin color/gender of the victim.
Lenity and aggravating/mitigating circumstances should be abolished. As should parole and probation.
