Any president is permitted under law (28 USC § 1498(a)) to use ANY US patent so long as "reasonable" compensation is paid to the holder.
I hope that when Kamala Harris is elected our next president she will work to ban "evergreening" old drugs that should have been out of patent and generically available years ago.

- Wellbutrin (antidepressant)
- Celebrex (arthritis)
All of the drugs above gamed the patent system for at least NINE additional years of patent coverage, with
celebrex getting THIRTEEN years of additional coverage via five "new" patents on the same drug.
As incidents of breast cancer rose, many patients suffered prior to Obamacare for being unable to afford Tamofaxin. Health care costs rose overall because of pharma games like this.
Interestingly, once Pepcid and Claratin went off-patent, the government immediately made them non-prescription and the price went down to next to nothing.
The current evergreen drug champion is Lumify, which was patented in 1996 and should've expired in 2017. It is a "second generation" red-eye-irritation relief med replacing ancient Visine drops. It is now protected until 2030.
