If your rebuttal is section III does not require a conviction then what is the foundation for the ruling? No trial, no conviction just an arbitrary ruling predicated on what? Communists (that is, real communists, in the Karl Marx sense) set about building workers' democracy with the intent of increasing living standards in order to end the need for money, classes and government to even exist. I don't see Democrats doing that in any way, as they enrich billionaire capitalists, like the Republicans also do.

Communists seek to build workers' own government, judges, laws, armed people etc. and would only do something like an insurrection in order sweep away the capitalist government and authorities at the correct time, such as what the Russian Bolsheviks did in 1917 with the October Revolution. On that day (November 7, 1917, using our calendar), they swept aside the capitalist government and transferred all political power to the Soviets (i.e. workers' councils, which were controlled by workers, peasants and soldiers). This was only done when the Bolsheviks had a majority in the Soviets in the working class dominated cities in Russia, which took months of struggle, so the insurrection was done in order to put all power in workers' hands and sweep aside the capitalists who only take from them.

History is fascinating to learn. It's all out there.
