What does immigration law say that is being interpreted against the constitution by the administration? and if this is the case, why haven't states brought lawsuits? Seems like a violation of this would be a cut and dry case.

The biggest problem with immigration for the past 15 years is that the law is being disobeyed. Not ignored, intentionally disobeyed.
