Delaware’s state constitution has been in place since 1897. The legislation that was struck down was passed less than 2 years ago. Because state laws must conform to state constitutions. If state laws are passed that violate the state’s constitution, they tend to get struck down in court.Oh look, yet another bad faith argument.
