ST. PAUL, Minn. (AP) — Former Minneapolis police Officer Derek Chauvin pleaded guilty Wednesday to federal charges of violating George Floyd’s civil rights, averting a trial but likely extending the time he is already spending behind bars on a state conviction.

Chauvin, who is white, was convicted this spring of state murder and manslaughter charges for pinning his knee against Floyd’s neck during a May 25, 2020, arrest as the Black man said he couldn’t breathe Chauvin was sentenced to 22 1/2 years in that case.

My understanding is by pleading guilty, he'll get a sentence that will run simultaneously with his existing one and which will run out long before his existing one. If he'd taken his chances on a trial, he might have ended up with even more time in prison. This was probably his best option if he ever wants to be free again.

because according to Dicksey, you'd have to coincidentally take a shitload of Fentanyl that conveniently kicks in and overloads your systems to cardiac arrest just before a White cop puts his whole weight on your neck when he didn't have to.

Think about that. He was IN CUSTODY when he died.

A person in custody is entitled to have his medical needs seen to. A person suffering a medical emergency is entitled to have immediate medical attention provided to him for that emergency. He cannot, because he is in custody, seek such medical attention for himself so it must be provided to him.

Denial of immediate medical attention for a potentially life threatening event is a violation of the 8th Amendment against cruel and unusual punishment. It also makes the person denying the medical attention liable if the victim suffers additional injury or death.


Now think about this:

Chauvin was a trained police officer. Part of his training is about recognizing the need for medical intervention for persons in his custody after arrest.


Now put those 2 things together and realize that Floyd MIGHT HAVE died if he'd been left on his own. He might still have died even if he sought help for his OD. However, he WASN'T on his own, he was IN CUSTODY. Chauvin's decision to deny medical help to Floyd is why he's liable for Floyd's death. The Fentanyl was the basis for the OD, but the affirmative denial of medical care is the reason Floyd died at Chauvin's hand.

It's called "proximate causation."

Had Chauvin let the EMT's do what they could with Floyd, even if he fought with them, he'd have been in the clear because he'd have done everything humanly possible to save the life of someone in his custody.

If the EMT's had tried then stopped treating Floyd, because of his aggressiveness, they'd have been in the clear.

Chauvin, actively prevented anyone from getting to Floyd. The other officers on the scene actively assisted in that prevention. THAT is why they are liable for Floyd's death.

Whether the fentanyl MAY HAVE killed Floyd is something we'll never know because Chauvin's efforts ensured that he would indeed die.
