It is the point because it's relevant to the law. The Georgia law, not the one in your head.
There was no evidence that he stole anything. Therefore he was guilty of (at most) trespass - a misdemeanor. Georgia law at the time, did not allow a private citizen to make a "citizen's arrest" for a misdemeanor. Even if he did steal something, the law required that the defendants would have had to have observed the crime.
