WASHINGTON (CN) — Upholding a New York City prosecutor’s subpoena for President Donald Trump’s tax returns, the Supreme Court ruled 7-2 Thursday that presidents are not immune from state criminal proceedings while in office.

“Two hundred years ago, a great jurist of our court established that no citizen, not even the president is categorically above the common duty to produce evidence when called upon in a criminal proceeding,” Chief Justice John Roberts wrote for the majority. “We reaffirm that principle today and hold that the president is neither absolutely immune from state criminal subpoenas seeking his private papers nor entitled to a heightened standard of need.”

Separately this morning, the court punted on a related case involving subpoenas of Trump’s financial records from House Democrats.

Roberts joined the liberal wing of the court in both cases, as did Justices Brett Kavanaugh and Neil Gorsuch, both Trump appointees.

Lock Him UP!!!!!

Not for some time apparently. Trump's lawyers are kicking aspects of it back into lower courts to work its way up again. Meanwhile, it's fodder for Biden to claw at Trump with "I've released twenty-one years of tax returns," your (Trump's) tax fraud must really be something (which I'm sure it is) that you are fighting so hard not to let yours be released.

Only to Congress as far as I could read. Something about separation of po0wers, but he was a private citizen during the years of records they want, so I don't see how that applies.

Oops. Looks like he’s about to lose his protection from indictment as well.

The Supreme Court just wimped out on Trump’s tax returns — and handed him a political victory

A cowardly Supreme Court punted today on the criminal investigation into whether Donald Trump, his Trump Organization and others are major league criminal tax cheats.

The high court held that while Trump cannot shield his tax and business records from New York State prosecutors, Trump was entitled to pursue procedural challenges. That could mean months, even years, of delay in the garden variety criminal investigation by Manhattan prosecutors into whether Trump is a garden variety tax cheat.

Justice delayed is justice denied. Roberts and Barr are playing the system for Hair Furor.:mad::mad::mad:

The big win--and Donald's tweets reveal he understands that--is that the Supreme Court unanimously (including the two Trump has put on the court to protect him) ruled that he isn't a king and is not above the law, whether in or out of office.

Why no release to Congress, though? Keith has a point about the rule of law, but by that kind of logic, especially in terms of accountable government, he should be subject to Congressional subpoena as well.

Sure but as long as there are at least 50 spineless Republicans who believe otherwise/are reliant on Trump's version of charisma then he won't get impeached or wind up booted any time soon.

That being said there's nothing that says he can't be impeached again right now...

There's logic and then there's legal logic, those are very different things. From my understanding it's that Congress too has limits on its power and can't necessarily going on a fishing expedition through information that isn't publicly available.

If the Democratic party retakes the Senate on January 3rd, Trump could be removed from office by the 4th.

That would be wonderful.

Of course you'd need to not just remove Trump but the whole root system in place that he's done to damage institutions from Congress, the Department of Justice, the Department of Education, and...well basically everything that the government is supposed to do.

Thomas Frank said it best in summarizing his book The Wrecking Crew: "Bad government is the natural product of rule by those who believe government is bad."
