Here are my feelings on this heartbreaking incident. The self defense/ castle doctrine is overly broad. The use of deadly force in this incident is unjustified. Even if simply by the fact that the victim was outnumbered. Secondly if you intend to make a citizen's arrest (which was not legal in this case) you must be held to the exact same standards as law enforcement. Namely, reasonable, articulable suspicion of a crime. There was absolutely none here. Secondly you assume personal liability for the outcome. You will be held personally liable for any civil rights violation. You will be held personally liable for unwarranted injury or death. That means you LOSE EVERYTHING. You go to prison. You lose all your possessions in the civil trial. These two assholes need to be screwed hard to serve as an example to the other fuckwads out there.
 
The Brunswick Police Department is highly dysfunctional.

The police chief is currently suspended with pay for lying to the GBI about his drug task force pocketing drug dealers' money.

The police force was pilloried last year for responding to a domestic violence call. They arrived onsite, noticed the man accused of domestic violence was a former officer, had a few laughs with him (recorded on body cam), then left with no action taken. The ex-cop then shot his ex-wife, her boyfriend and committed suicide.

And now this absolutely racist incident.

What would you do if you saw a black man running down the street. These guys were obviously scared for their lives.
 
I don't think the Self Defense / Castle Doctrine will apply here. Travis McMichael was not in his home or vehicle (he was outside his truck) when the shooting occurred. Nor should self defense apply, even though his lawyer will argue that, because Travis initiated the shooting by brandishing a firearm. I was taught in CCW class that if you initiate a confrontation with a firearm, the self defense defense is basically forfeit.

I agree that deadly force appears unjustified because McMichael confronted Ahmaud Arbery with a firearm. Arbery attempted to defend himself against an armed assailant, but was killed defending himself. I wonder if Arbery would have been better off to run away, risking the McMichaels shooting him in the back. But we will never know.

The McMichaels are going to get sued big time.

This is how things work in America.
Very few lawyers are going to take a win-win case on their dime.

My criminal law instructor in college, who is black, once told the class that all those "equality laws" shouldn't be necessary. Because the law doesn't see skin color or gender.

Then he told us that because some people only see skin color/gender, that's why those laws exist.

It was rather profound when you get beyond the surface of the words used. I don't have a problem with anyone not wanting to personally associate with other individuals because of their physical characteristics and traits. If they want to take that stupidity into the sphere where the law says they can't do that kind of thing, then they get what they deserve.

I do have a problem with the law treating people differently because of either the defendant or victim's skin color/gender.

Based on the video, those two assholes murdered someone. It doesn't matter if the dead guy was black, white, orange, green, or any other color in the crayon box, he was a human being and it looks like they just murdered him.

Upon conviction there should only be 1 penalty for that. And the degree of punishment shouldn't depend on the color of the victim's skin. If they're guilty, hang 'em. Hanging them from a morally higher branch doesn't change the manner of carrying out the sentence or that they're just as dead afterward.

The original explanation I saw from the idiot in Brunswick was maybe the most illogical thing I ever heard — something along the lines of "If a man aims a gun at you and you make an attempt to defend yourself against him, it automatically becomes a self-defense scenario for the armed man and therefore he's now allowed to shoot you."

Joseph Heller couldn't have dreamed that one up.
