But even with the modern nature of the US military, current US law still maintains a militia classification structure. It’s quite broad…

(a) The militia of the United States consists of all able-bodied males at least 17 years of age and, except as provided in section 313 of title 32, under 45 years of age who are, or who have made a declaration of intention to become, citizens of the United States and of female citizens of the United States who are members of the National Guard.

(b) The classes of the militia are—

(1) the organized militia, which consists of the National Guard and the Naval Militia; and

(2) the unorganized militia, which consists of the members of the militia who are not members of the National Guard or the Naval Militia.

But given the question’s reference to events underway in Oregon, and following on Dexter's answer, whether any group of citizens may come together and define themselves as a duly organized citizen’s militia is, frankly, a grey area. Few States have any mechanisms to legally recognize such groups as organized militias – which usually require some kind of command structure from the Governor on down – but nor can they be forcefully broken up in the absence of criminal activity.

They’re basically legal by virtue of being not explicitly illegal. But to consider that any of them would ever be called on by authorities in the event of a State or National emergency, though, which may have the effect of recognizing them as agents of the State as may be provided by law, would be far-fetched.
