Specific intent and materiality have to be proven. Did he know he was making a false statement he believed was true? If he made a statement he thought was true at the time he made it, though it was false, is not proof of perjury. Was the question all encompassing or just confined to the activities of the campaign? Sessions spoke to the Russian Ambassador, considered by US intelligence to be one of Russia's top spies and spy recruiters in Washington, in his capacity as a United States Senator.
Therein lies the rub.
