The President can not only order the surveillance of an American citizen he can, as CnC, order his death by drone like Obama has done. To submit an application to the Foreign Intelligence Surveillance Act Court in order to surveil a sitting Senator or a political candidate you'd have to assert they were agents of a foreign government. If their part of the conversations were incidental to the warrant, as American citizens, the law requires their names to be masked and classified.
