In other words, you are wondering if the law Obama would be breaking specifically mentions Gitmo and the continental U.S. and makes a distinction between the two.

According to the United States Supreme Court, legally it doesn't matter if the GITMO detainees are in Guantanamo or fucking Iowa.

It's not illegal. Obama could be a balla and just pay out of pocket. The only thing Congress actually did was deny him use of Federal Funding to transport them to the United States.

Don't worry as usual Obama will let the law get in the way even when it's wrong and be a worthless bitch. He's drumming up support but he knows his place unfortunately.

Also yes Gitmo is technically in the United States but exists in this absurd legal fiction.

What about other military bases and embassies? Are they "technically" in the United States too?

Generally that would be yes but it's really complicated and ultimatley GITMO is it's own animal.

Miles failed to explain it and I'm currently looking for proper citation but as I understand it Congress just specifically refuses to pay for it. They control the purse strings ergo Obama can't move. Checks and Balances in action.

But hey I'm having a hard time with citing it, perhaps miles knows what miles is talking about. We all know that's asking a bit much but still.
 
And the UN is located in NYC, but if you go on the property, you are no longer in America, but in international territory.
