It's really incontestable, unless of course, one is an activist. Whether one chooses to think it's right and moral or not is a mater of personal preference. But the law is obviously constitutional as long as it's a state law.

If the state creates a legal union which two people can enter into giving them certain legal privileges, then, under the US Constitution, it can no more specify what sex they have to be than it can specify what race they have to be.

Civil marriage is a legal contract between consenting adults. Period. Case closed.

Public opinion on prop-8 was strongly in favor of allowing gay marriage. Then 50 million dollars of out-of-state money led by the Mormons poured in and flooded the airwaves with hateful, distorted ads. Anyone remember the commercials saying that unless gay marraige was banned that your kid's teacher was going to teach your son or daughter HOW TO BE GAY?

That's literally what they said. That and worse things. Then opinion changed a few points.

So, an opinion that was "strongly in favor" changes to a 48-52 outcome by changing "a few points". That does not compute.

And in all fairness, do not forget that the "50 million dollars of out-of-state money led by the Mormons" was matched by 40 millions in opposition to the proposition (actually 43 millions against 39). Or did that not fit into your narrative?

You know, if it takes a European like me 2 minutes to find things like that on Wikipedia, it is stupid to rely on people not finding it out, or pointing it out, in a debate. ;)

Anyway, this is what a constitution is for. If you do not like it there are ways to change it. They are not as easy or quick as passing a simple law or holding a referendum, and there are plenty of people who will hold veto powers in that process, but that is precisely the point.

Oh Please. Just because a law is a state law does not make it constitutional. And it's not incontestable. It limits individual rights so it's contestable.

The difference is that one side campaigned on promoting freedom. The other side campaigned on pure, unadulterated fearmongering lies.

Like how your kids will learn to be gay in school. In elementary school at that!

Like how if gays somewhere that you'll never meet get married that YOUR marraige will be damaged.

Like how the Church of Latter Day Saints is under attack a vicious attack from the government and only votes can save it.

Like how churches would be taxed if gays get married.

Like how priests and ministers who refuse to perform gay marraige would be arrested???


All of these messages were plainly laid out in TV and radio commercials that blanketed the airwaves in California. You can go back and watch them on YouTube.

Some people remember that this was the worst, most deceitful campaign in American history. You should too.

No. The will of the people won out.

The people of California have an equal protection clause in their constitution. The judge honored that.
