Funeral picketing law struck down

TOPEKA, Kan. - The Kansas Supreme Court effectively ended a law banning picketing at funerals, ruling Tuesday that it was unconstitutional for legislators to require a court to uphold the law before it could be enforced.

That "judicial trigger" was intended to prevent the Westboro Baptist Church from collecting damages from the state after a successful appeal of the law.

The law was passed in response to the sect's picketing of military funerals; the Rev. Fred Phelps and his followers claim U.S. combat deaths are God's punishment for the nation's tolerance of homosexuality.

Ruling on a law before it can be enforced usurps power from the Legislature, Justice Marla J. Luckert wrote in the unanimous ruling.

"Courts do not have jurisdiction over purely hypothetical questions associated with nonexistent issues," she wrote.

The court did not address the merits of the 2007 law, which bars protesters from being within 150 feet of a funeral one hour before, during or two hours after a service ends. It also makes it unlawful to obstruct any public street or sidewalk.

The law also allows families to sue if they feel protesters defamed the dead. That single provision survives after the court's ruling.

The federal government and at least 37 states have enacted such laws in response to Phelps and his church.

Within hours of the ruling, state Rep. Raj Goyle urged a House panel to pass a bill that's the 2007 law without the court trigger; he also added language allowing people to sue for emotional distress. A hearing is planned next week.

"The court's ruling was strictly about a legal technicality, not the restrictions on protesters which we believe are constitutional," said the Wichita Democrat.

Shirley Phelps-Roper, daughter of Fred Phelps and attorney for his Westboro Baptist Church, said the Kansas high court's ruling was "surprising, but it's lovely."

"They didn't need to invite the Legislature to take another run at what is a lost cause," Phelps-Roper said. "Nothing they put their hands on impacts us, so why keep messing with it?"

Gov. Kathleen Sebelius urged legislators to respond quickly, noting the bill last year had broad support and "protecting the privacy of grieving Kansas families, as they mourn the loss of a loved one, remains a high priority."

"I'm appalled with those who choose to add grief to the families of our brave soldiers and other fallen Kansans. I look forward to signing a constitutionally sound measure as soon as the Legislature gets it to me," she said.

Phelps and his church, long known for a public campaign against homosexuality, began picketing soldiers' funerals in June 2005 and have protested at some 330 funerals in 47 states.
 
I'm mildly surprised they haven't had their church burned down.

I hope some families sue the daylights out of them. I can't imagine having to go through a lawsuit while grieving for a loved one, but hitting them in the pocket book might be the only way to get to these people.
 
All the states need to adopt something like this.

I've heard of gangs of people showing up at funerals only to try and hold back these dip wads.

I'd be part of that group, should I hear it's going to happen in my area.
 
The ones I feel sorry for are their children. Imagine growing up amid all that hatred. :(

I've had them in some of my classes, actually.

Brilliant children, warped views.

And they know the law - they all know the law. They know exactly what they can say and do, where to stand, how many feet away from the curb or the business, for example, how to picket, exactly how to legally get away with their horrible hate-mongering.

And it's hardly a church. It's just a few family members, less than fifty.

And they love publicity. They are media whores. They go wherever the television cameras will be.

But Rev. Fred is aging. I think when he goes there will be some major reshuffling of the group.

Snyder, who was killed in the line of duty on March 3, 2006, and whose funeral was picketed by Phelps, sued Phelps and the Westboro Baptist Church, Inc., in the U.S. District Court in Maryland, for defamation, invasion of privacy, and intentional infliction of emotional distress. The lawsuit also involves accusations made on Phelps' websites that Mr. and Mrs. Snyder "raised [Matthew] for the devil" and taught him "to defy his Creator, to divorce, and to commit adultery".[77] On October 31, 2007, a jury returned a $2.9m verdict in favor of the plaintiff.[78] Later, the jury returned in the afternoon with its decision to award $6 million in punitive damages for invasion of privacy and $2 million for causing emotional distress.[79] Phelps then announced his intention to appeal the decision.

On February 4, 2008, U.S. district judge Richard Bennett reduced the amount of damages awarded in the case to $5 million. Bennett's ruling cited the need to weigh any harm Snyder suffered against the financial resources of the church. The church's appeal of the verdict is still pending

Hopefully it's enough to bankrupt the whole bunch of them. These are truly evil people. :(

Sadly that is true about Hate and love. However it does take a Big person (and I am not talking fat....though in some cases it helps) person to Love. Sadly though Phelps and his church are bringing so much hate and intolerance that he basically dragging the world into hell.

While I do not condone homosexuallity, I am not going to judge or hate a person becuase of the lifestyle they choose. My play sister is gay but I still love her with all my heart.

*Sigh!* For the most part, I've always said Live & let be" But if we let these bigots run rampant, the whole world would goe down the drain to these Phelp's people! I am Wiccan and tend to fear and try to keep my distance from Christians, (including my own anglican family) I am hetero, but accept and have some friends that are Gay & lesbain. As long as they don't try to force their tasts on me I won't try to force hetero upon them. But this Phelps is the most bitter and destructive non-member of society and brings to mind a quote from someone else on list that says to the effect Some don't deserve the effort to die, even though the don't deserve to live either! My sis is Arkansa and Baptist with an american hubby and young son and I can't even talk to her because she abuses me everytime we try to talk because of my being a witch, (witches are NOT! evil, the just are much closer to the Mother & father, Lord and lady and the spirits of nature than the organized religion heads of society. I cannot say "live & let be in Phelps and his baptist bigots case! Quesla

That it is, so I think it should be done right. I've always felt that the offer of making Christians martys is just not done nearly as much as it might be these days, and Fred Phelps and his incestuous little family church have demonstrated that they're devoted to Jesus as much as anyone. Why should they be denied an opportunity to sit at the right hand of God as a group, together, all at the same time?

I'm sure there's a downside to this somewhere, but durned if I've been able to see one.
 
Yeah, I just don't get these folks. And to be honest, I just don't understand hatred in general.

But you know, its not just these inbred MFers, it's so many others that claim to be Christian. Like the hypocrite John Hagee. He preaches constantly about adultry being evil and sinful, and yet....his first marriage ended cuz he was having an affair with a woman an the church he used to belong to. He later married the woman after being expelled from that church and starting his own. But he still preaches about the sins of adultry and intolerance in general.

And then, he also has made statements that the devastation of Katrina was brought about because of homosexuality in New Orleans.

Why is it...that some christians are only happy if they condemn others?

It reminds me of this girl I knew in high school. She was somewhat holier-than-thou. And it used to really put me off.

About 15 years later I ran into her and we got to talking about alot of things.

I was shocked to hear her say that Christianity is a religion of love. And that all are welcome, no matter what. And that no one is entitiled to pass judgement on another as that is Gods job.

My opinion of her changed.

Some people DO get it.
