There are two parts to this claim a) a Right of Publicity claim under California state law b) an infringement of Copyright claim under Federal law. The use of AI is incidental to the former but central to the latter.

If the Carlin Estate succeeds under a) but fails under b), the result will still be problematic for many ‘mimicry’ uses of AI in California. Would that spill over to other states, let alone the rest of the world? Wait and see.
