  • The article specifically says that he underwent surgery on December 22.
  • After that surgery he was admitted to the ICU for complications as a result of the surgery.
  • It doesn't matter what he did after Jan 1, he was AWOL on DECEMBER 22nd.
Absent without Leave is not applicable when a soldier is hospitalized. He was in a military hospital facility - you know the military doctors knew he was there - not hiding under a false identity. Not timely informing the President is a different protocol issue but certainly not one of being AWOL.

There was nothing willful about the absence.
