This guy is NOT a judge. However, I believe the JoP's in Lousiana are elected locally so he may be correct by refusing based on the moral standards of his small, local parish. I don't know.

The real question is the - Why didn't they simply go to another parish and apply? I just checked. Hammond, LA is only 45 minutes from Baton Rouge. The city is 54% White, the rest Black, Native American and Asian. :eek:

I've known judges to do some crazy stunts. People become judges because they cant make any money as lawyers.

But I wonder how accurate this report is. I'd bet my money that something is wrong with the license-application and the couple is playing the race card.

It only states his reasoning as concern for the offspring.
Yes, the race card does get played, as in many factions. Which is even more frustrating to those in the same demographics, ethic group, religion, etc than to those outside those groups.

I did wonder what would have happened if McCain had been black.
 
His misguided interventions into something outside his authority will catch up to him soon, I would say.

But why leave it for the next person?

Whose responsibility is it to point it out or inconvenience themselves enough to make sure it doesn't happen to someone else?

It's wrong, should stop, and in order to do that, you have to bring it to the attention of the authorities who can change it.

"Just step around it" doesn't clean up the steaming pile of shit that could so easily be cleaned up if someone bothered to take the time to do so.

Unfortunately, it does sound like these folks weren't the first couple to be refused by this JP. But I certainly hope they will file suit.

Actually, I don't believe anyone can sue a judge or JoP. They could, however, sue the City or the Parish (if they can afford the battle).

Ah! A Justice of the Peace, which is like no judge at all. I suppose they can refuse to marry people.

In Florida judges can marry children to adults but I dont know that you can force a judge to do it. I wouldnt marry a child to a grown-up.

I think it has to do with "capacity", James B. A judge is compelled to follow the law to the best of his knowlege. A JoP is about one step above a Notary Public and is not.
 
Louisiana was a pretty fucked up state even before Katrina.

Yeah, there's some great people there and amazing food. But it has some of the deepest bipartisan political corruption in the country, and yeah, huge parts of the state where open racism is still ok.

I strongly suspect that the ACLU has already contacted the couple offering to represent them in such a suit. I also doubt that the JP can be sued, :confused: although he let his personal prejudice get in the way of doing his job, and that might constitute grounds. I'm sure they can and will sue the local jurisdiction. :cool:

The personal losses they suffered are minimal, if even that, but they can go for a lot of punitive damages. :cool:

Judges are at liberty to contrue the law however they want. Where they get in trouble is when they create conflicts with their own interpretations of the law. If the law says 'white' they can and do construe white to be black. Juries do the same all the time.

It's messed up the twisted things that still go on, while the normal things, like two adults that want to do something perfectly normal, have to deal with nonsense.

I thought people in positions like that were supposed to be unbiased. :confused:

Judges get to do pretty much what they want.

We had a judge here who was severe with drunk drivers; he didnt play with them. The first conviction for DUI was jail plus a big fine, the 2nd conviction got you a bigger fine and more jail time, and if you came back for 3 he made you destroy your car at the courthouse while he watched. The ACLU went nutz.

I like his approach. I've known people here who whine about having to have those breath things in there cars. Tough, you're lucky you ever get to drive again. Killing someone 'cause you couldn't take a cab isn't a chance anyone should take.

As the adult product of a loving interracial marriage, I call BULLSHIT. This judge is a racist asshat. Thinking of the children? Biracial babies are the shit, and we know it. My parents got married in the 70s, when the Midwest was still as bad as the South, and they're still together. I wouldn't have been raised in any other environment. And frankly, now that I'm living in a country that's nearly homogeneous, I've come to appreciate just how wonderful it is that there are countries full of various races and cultures.

He was serious about drunk drivers, but pissed off too many drunks, and the Supreme Court jerked him off the bench. Cutting up cars was what did it.

In the paper today, the local sheriff arrested 68 people for outstanding warrants, and the judge released all of them without bail. All the arrests were for not appearing in court.

Its all bullspit.

Even ministers don't have to marry everyone who asks. I knew one who wouldn't marry anyone who had been divorced.

In case you haven't noticed, there are a lot of weird people out there. All with assorted opinions. Suprised they don't all belong to the A/H.:)

Ministers are definitely "church" - but this is "state" - entirely different set of standards.

Agreed. If this guy wants to keep on "not" marrying certain people, then he should start a church and not do so as a minister.

Don't believe in evolution? Okay. Don't be a science teacher.

Conversely, if you have no faith on God, you have no place being a priest.

If your job is to carry out a purpose and you obstruct that purpose, it's reasonable for those who employ you to end that employment.

I'm fine with principles and beliefs. It's not illegal to be an asshole. But I'm not fine with putting yourself in a position to bottleneck someone's rights.
