I know that no one will punish her. I am saying that if she goes to one, her husband will file divorce, and then immigration will deport her. They wont deport her because she is trying to get out of the abusive marrige, I am saying that they will deport her if he divorces her.

But he may not file for a divore, and she will stay. But if he divorces her then she gets deported. Thats my understanding, I need to get incontact with a lawyer, he/she will be able to tell me I am right or wrong with what I said. And tell me what will happpen if she goes to a shalter.

I want her to leave him ASAP, right now if she could. I do not want her there with him, I want her out of that marrige as soon as she can.

There are lots of factors to consider, but she can't stay there, and she needs to see a lawyer.

Okay, a little info here.

the INS cannot, and will not deport anybody as long as their case is running, regardless of circumstances. not while the case is still active.

yes I agree with Creamylady. lawyer would be very good at this point.

and there is also several papers that need to be filed in order of cancelling, or postponing deportation.

And even a million more that can keep her in the states. However an Immigrations Lawyer at this point will be the best thing to do.

One question I have, is why is her asshole husband not so concerned about fighting sharges of spousal abuse and trying to stay out of jail to be thinking about divorce?

Another question is, Why does she need an American Green card as a resident alien to leave the US? I should think that an Australian visa and a plane ticket is all that is required.

Her husband is really an idiot. I mean she has been having an affer with me for well over a year, and her computer is not even 5 foot away from his computer, he uses his computer all the time to play MechWarrior 4, and all he had to do was to look at her screen and see whats going on. Plus we have sent one another presents with over the $100 mark, and he had no idea why we were. We also ring each other.

She needs a green card to get back into the USA. She can get har VISA and come now, but she won't be able to go back to the USA ever again if she dose not get the American Green Card.
In the future she may want/need to go to the USA, I might get a job there and need to live there.

Today he found out about our plans for August-September. And he hit her and really hurt her.

If he hit her and really hurt her, why aren't the police involved and he in a holding cell awaiting araignemnt? I should think that would take his mind off of immediate divorce proceedings.

It might make him want to file, but it would also force him to finance a criminal defense instead of having the money available for a divorce attorney.

More plainly, why is she letting him run free after injuring her?

I do not know, ha, that the first question I can not answer. I'll bring that up with her, and get back to you on that.
