What do you think of the court ruling on the lesbian affair?

Its in the news section of this (Literotica’s) site...Basically a man wanted to divorce his wife and based his legal reasoning on the fact she had an affair with a women while he was married to her. However, the court ruled the affair she had did not constitute an affair because by their definition a woman cannot have intercourse with another woman. They claimed according to the law lesbian sex was not REAL sex.
 
I think it's still an affair, but I think the guy needs to get involved, what the hell is wrong with him. Unless she is just shunning guys all together... The thing that makes it an affair would be the fact that he was not okay with that, and she violated their marriage agreement I guess. Ain't love grand.... I hate divorce.
 
Apparently, the court based it's decision on existing case law. While the divorce statute doesn't specifically define what constitutes adultery, it seems that a working definition has been established through case law. I'm guessing that what they means is that in past cases involving heterosexual couples, the courts in New Hampshire have ruled that sexual conduct other than intercourse did not constitute adultery in those cases either.

That is a very bizarre ruling (IMO) even for heterosexuals. To many, oral sex is more intimate that any other sex act. How that can't be viewed as adultery is amazing to me. I would like to read the case law on that one some time.

Uh huh...cheating is cheating, from any reasonable standpoint.
 
Yea wasn't the exact quote, "I did not have sexual relations with that woman, Monica Lewinsky" (remember how important that pause was).. :)
 
sex of any kind with another person that is not your significant other is violating the bond you have with that person. unless of course your SO is ok with it and/or wants to join.

Yup. Same-sex cheating is still cheating; it's too bad the court didn't see it that way.

What's so utterly depressing for me regarding this case is the law itself. Laws are the last thing to change. Society has to change first, then want the laws changed to reflect societal norms. We aren't even to step 1--society has to change...yet. *le sigh*

tho, it isn't about the penetration of the puss in this case, or even that it was same-sex, but because it was two women (and no penis).

Another argument for the ruling is that penetratory sex (with man parts) is more dangerous because you can catch diseases. But you can still catch diseases orally, no? It's really easy to use various condoms for sex but not really for oral. You're supposed to, but who likes licking/sucking latex?
 
And I couldn't agree more about the oral being more intimate. I've always had a hard time relating to the everything-but-penetration approach because I've always considered oral to be far more intimate and therefore require a greater amount of trust and knowledge about that person. And I mean, that's my MOUTH...with which i breathe and eat and use to tell my mother that i love her. can someone please explain to me how that's not capital r Real Sex?
