No problem. I'm willing to concede that at this point it's whatever the Court says it is, penalty, tax, or pink elephant, and in the absence of repeal we're stuck with it.
But for the sake of friendly argument, the only reason why Roberts declared in the opening paragraphs of his opinion that the levy was a penalty was to get around the Injunction Act. He then goes on to argue the Statute unconstitutional under the Commerce Clause, the main congressional and government legal basis for the law. Then he swerves into completely new ground by finding that it is both a tax and a penalty, something never before done in the history of our jurisdiction, as amply documented in the dissenting opinion. But so what, right?
And the notion that Obama care levies no tax on the Middle Class is false. It levies a 3.8% tax on investment income. The $200,000 threshold includes the sum of wages plus investment income. So if you and your wife earn $175, 000 in wages and have $30,000 in investment income which puts you over the $200,000 threshold, you add the 3.8% to your existing capital gains rate and pay the result on the $30,000. As an aside, after January 1, 2013 that rate will jump to 39% and you'll add the 3.8% to that number.

Seems to me that we're trying really hard to destroy the middle-class. I define the middle-class as the people who populate Main Street...MDs, accountants, garage owners, dry cleaners, etc. Somewhere along the way the pols joined a conspiracy with WAL-MART, APPLE, and McDONALDS et al to eliminate the competition, and transform America into Albania with peasants and elites.

Where do you get this shit? You have roughly 20% of American households making between $75,000 and $100,000 a year. What are they the underclass?

As has been pointed out by others, a very very small percent of Americans earn 250k. 90% of Americans make less then 120k a year, therefore to me, the middle class would be those earning somewhere between 50-70k.
I wish middle class was the 120k or 250k range, but realistically, it's not.
