The Death Penalty and the Mentally Retarded

Disagree only because of the discrimination.

If they get tried and convicted why shouldnt they get the same punishment?
 
I'm against the death penalty period. Besides the "humanitarian" issues (which are real), it's pointless. No one is better off. It's not punishment, it's revenge.
 
If someone killed one of my family, I want a revenge whether the offender is a nit wit.

Otherwise, killing is wrong.

BTW, didn't a black guy said not to kill the KKK who killed his father?

If you're mentally retarded, how can you stand trial? I know nothing of the law, but I thought that if you aren't mentally fit you go to a facility for the mentally infirm?


If you're fit enough to stand trial, you're fit enough to be responsible for your actions. That includes the death penalty.

How can a government forbid to kill if they do so themselves?
 
I think the problem is..oh, how can I say this right, I'm kind of sllepy and a bit drunk, so bear with me...

If the standard for whther or not someone can stand trial is if they can be determined to know the difference between right and wrong, that doesn't mean that they can neccessarily conceptualize the consequences of an action they know is wrong.

i mean surely they would be able to plead insanity and be able to have treatment instead of punishment ? be that the death penalty or prison time

or is this just extra insurance so that they won't have to face the death penalty ... in that case its probably a good idea
 
I am against the death penalty. But if it's there, it comes down to the basic principle...did the person know right from wrong. Some people who are mentally retarded do, and some don't.

I'm pro death penalty, but would be against it for the mentally challenged. I don't often hear of this section of society committing murder though.

What kills me are the kids who kill. It's just a gut-wrenching situation for everybody involved. I often think of those two boys who killed the toddler in England a few years back. They were very young...7, 8....and in the last year or two, I read they were released at age 18 with new identities. In that case, three families lost their children.

I'm rambling.

I can support the death penalty for certain people and certain circumstances.

Degrees always matter.

To claim mental retardation as a defense, in a court of law ,as in a
after the fact detail.. agian no ..sain as you or me.

I think people who have been convicted of murder with DNA evidence should be killed.

Should I draw that line, no. Lawyers, judges, the people I vote for should draw the line.
Death merits death, and I'm not talking manslaughter. "What accused merit death?" I'd only know on an individual basis. If you give me an example, I could tell you if I would vote for the death penalty or not.

Under proof of DNA and eyewitness and forensic evidence, I don't believe I would be killing innocent people.

Sure do hope the DNA test is not fuckered up.
 
What about in Oklahoma where the state Forensic Scientist was foudn to have doctored evidence? TO have made up testimony in hundreds of murder cases? WHere hundreds of cases are now being reviewed? Where at least one man was KILLED due to her false testimony?

DNA evidence is not the savior of false convictions. It never was meant to be such.

Does someone with Downs Syndrome get killed?

What about someonw who is simply not intelligent? Is that a mental defect?

What about a stroke victim with mental lapses?

If you endeavour to kill people. You have to be absolute. No degrees.
