The appeals and Supreme courts in numerous states deemed him so. In the state of Colorado, the complaint was brought BY republicans. SCOTUS also deemed him so in the last 9-0 decision as well by explicitly NOT addressing that allegation and instead saying Colorado's decision would upset the federal elections. The 3 liberal judges even called the defendant an "oath breaking insurrectionist" on several occasions in their dissent. You're a lawyer use your lawyerly skills and show this layperson to be wrong.

Let me clarify even more what I mean here.
SCOTUS is NOT addressing if trump has immunity. That's would be silly because no one has a lifetimes worth of immunity. Reading from its letter to Jack Smith - it will only be deciding if trump's actions on January 6th fell in line with actions within the scope and privilege of the president.
