I wonder if China registered the balloon with FAA, DOT/DHS and entered US airspace complying with *US code 14 section [91]* if not, then China doesn't have a leg to stand on, could be treated like any drug running aircraft.

I would think that with all the sophisticated electronic surveillance capability our NSA/DNI/CIA/FBI/MIL INTEL THEY could intercept any signal traffic originating from the balloon, even if encrypted we'd know there was signal traffic traceable to the customer.

It does seem stoopid to use an air-to-air missile, but it's been said that the US does not have much else in options for that altitude. Most fighters don't have Gatling guns that way the A-10 does or older WWII aircraft did.

Over land and possibly hurt someone, or in the drink where it may be damaged by seawater ..... hmmm....

If they knew about it and didn't shoot it down, the next step would likely be to disrupt any transmission.

Actually the use of that AIM-9x was sending a signal to would be adversaries. That balloon had no heat signature.....think about that for a while.
