Blame Literotica, not the government

Folks, I apologize in up front for both the length of the following and the fact that it has nothing to do with our treasured nipples. After doing a little research on the Internet as a result of my (shared) frustration over the site's recent censorship, I wanted to vent a little.

Regardless of the numerous and glaring faults of the administration or the US courts, they are no more to blame for the removal of photos from Literotica than Smith & Wesson is to blame when someone murders another person using a gun they produce. Literotica is pulling the trigger, not Bush.

Title 18, Part I, Chapter 110, section 2257, paragraph (a) states

Whoever produces any book, magazine, periodical, film, videotape, or other matter which—

(1) contains one or more visual depictions made after November 1, 1990 of actual sexually explicit conduct; and

(2) is produced in whole or in part with materials which have been mailed or shipped in interstate or foreign commerce, or is shipped or transported or is intended for shipment or transportation in interstate or foreign commerce;

shall create and maintain individually identifiable records pertaining to every performer portrayed in such a visual depiction.

All subsequent paragraphs of this section tie in to this paragraph. Near the end, in paragraph (h), item (3), the following is included with the description for the term “produces:”

This would clearly rule out photos posted on Literotica. Literotica did not
- commission the taking of the images;
- hire the performers;
- solicit managers or act as managers; and did not
- coordinate or arrange for the participation of the performers depicted.

For example, explain how sites that deal in celebrity nude photos, movie clips, and/or home or amateur videos are not closing up shop and removing their material? Obviously they can’t “…create and maintain individually identifiable records pertaining to every performer portrayed in such a visual depiction” as they can’t document the thousands of celebrities (and/or associates) that are depicted in the material. So they need to purge a vast majority of their material and are out of business, right?

Wrong. Images produced by other parties, without any prior participation of these sites, is clearly excluded from the requirements of 2257 by (h) (3). If Bob takes a picture of Sue that is sexually explicit, Bob is the producer. If he wants to post or distribute this picture in some way, HE is responsible for adhering to 2257. The site he posts Sue’s picture on is NOT responsible as they did not participate in the production of the picture in any way – the site is excluded by (h) (3).

Literotica is clearly over-reacting. At WORST, all they need to do is state a clear policy that they do NOT get involved in hiring, contracting for managing, or otherwise arrange for the participation of the performers depicted in materials posted by members. They in no way solicit any postings but merely provide a community forum for erotic material for members to post materials under their individual responsibility. It's just like parking your car in a mall parking lot. The mall is not responsible for what happens to the car or its contents, even though the mall provided the parking lot for you to park in.

This is very interesting but there might be another consideration. I don't believe there should be but I am not sure. Most (not ALL) of the pics that have been posted are copyrighted. Frequently, I have gone to sites where these copyrighted pictures appear, free to anybody who wants to look at them, and I have downloaded them to my HD. Then I have posted them here, sharing them with friends. Since nobody is making any commercial use of threm, it doesn't seem to me there is any copyright violation occurring.

The law being cited refers to visual depictions made after November 1, 1990 of actual sexually explicit conduct. Some of the pictures in question are such depictions but most of them are nothing more than pictures of luscious breasts and captivating nipples. Since these would not be covered by 2257 anyhow, there should be no problem at all with them.

I thought of that, too, but the definition of "sexually explicit" in the statute includes the "lascivious display of the genitals," or words to that effect, so it is not entirely clear that most of the pics posted here escape that definition. As I recall, all of the pics Abbey posted last night were above the waist, and they still disappeared. Maybe tits are considered genitals these days.

The devilish thing about 2257 is that it appears in a chapter aimed at eliminating child pornography. We are not talking about child pornography here. But, the workings of the statute require that the producer of the sexually explicit material retain personal records of the models to be able to prove they are not underage. This means records of ALL models, and that's the problem. It's apparently not a copyright issue. I can understand content providers being sensitive to a law aimed at child pornography. Nobody wants that rap.

The other consideration is that many laws are either not enforced or enforced zealously. 2257 might be under an edict from our virtuous federal government to pursue 2257 evildoers to the ends of the earth, because we now have terrorism under control and the FBI is underemployed. It's possible that the Lit. people have received warning shots across their bow from the federales and are reacting accordingly.

the censorship issue was a problem several months ago as well. Lit shut down one of its most popular threads permanently (Muff's post any pic you like thread) and created a mass exodus to other "friendlier" sites. It looks like they are at it again....what a shame.....
