Don't thank me. She's been there for me the entire time I have been suck here, this was the least I could do for my sis. My brother lives just half an hour away from her. He was more than glad to go there for support.

The delay was due to the fact that the jerk of an ex had got himself a lawyer. Moonie's advocate however took care of things nicely. He says that she looked tried by the time they got done but that she had a smile on her face.

I'm so happy for her.

Sorry, I was late mailing my secret santa gift...got busy with court and finals and work ....and I was out of practice with making stuff so it took a bit longer. But that was so much fun...my little bright spot. Thanks for organizing it, oh and I loved your card

Sis, if you don't mind I was wanting to know how the hearing went. I guess I could bugg my bro but I'd rather bugg you.

I got to court at around 10:20, they advised to be there 30 mins before hearing. My advocate and I had all my papers ready and I had practiced what I was going to say and what I wanted to ask regarding the restraining order(they call it Order of Protection here). At 11am, I was taken to the court room.

We waited and he came in 2 mins later and he had a lawyer. We were not expecting that at all cause most hearing are done by just the persons involved or with an advocate. Anyways, the Judge put off the hearing till later so that my advocate and I could talk. I was on pins and needles the whole time.

During the hearing I told my side of the story. His lawyer asked me a bunch of questions. Then he had his turn telling his story. I sounded like I was mental case who was paranoid according to him.

The witnesses were asked questions by the lawyer, my advocate and the Judge. My problem was that I had no photos and most of the witnesses were his friends and they didn't believe me that he was abusive. I guess the Judge wasn't satisfied cause the hearing went over an hour. One of my witnesses worked at the emergency room and I think it was due to her that I got the restraining order.

According to the Judge, my ex cannot aduse me, threaten me, or harass me while the order is in effect. He has to leave the building/room if I am there. He cannot contact me. The Judge ordered him to pay for my filing fee also. My order of protection is good for a year. After that I can go back to court to get it extended.

There....my fun filled court day. I'm just so relieved that this is over.

One point, moonlight elf. [Warning: I am not a lawyer] If you voluntarily allow him to remain, even once, in a building/room if you are there, you effectively have no more protection. [It is a LOT more complicated than that.] If he needs to occupy a building/room while you are there, tell him he has a lawyer. Send the lawyer instead.
