FORT WORTH -- A North Texas businessman has been jailed after co-workers reported an image of child pornography showed up on a screen as he gave a computer slide presentation recently.

James Andrew Smith of Denton was in the Mansfield Jail under $300,000 bond after he was charged with two counts of possessing child pornography and one charge of promoting child pornography.

Exel Inc. co-workers told police Smith had just completed a PowerPoint presentation on Sept. 4 when he tried to open another document on his laptop computer. The co-workers said a photograph of a nude young boy appeared on the screen.

Based on the bond amount, he'd need approaching thirty thousand just to post bond, and that's money he'd never see again.

Interestingly, in Texas, a "child" is anyone under the age of 18 for child porn purposes, but the age of consent is 17. That means you can have sex with a seventeen year old, but can't take pictures of her.

bond amount has zip to do with conviction.
th thing is...it seems real easy for the defense to claim he wasn't responsible for the images on the lptop...especially if it was a COMPANY laptop. furthermore, if he collaborated with nyone of the project aspertions can be cast at them. what about the whole "was the laptop ever out of your site?" thing? hell, he can say someone in the company was trying to set him up. not even criminally, just a practical joke that was in poor taste and went way too far and now they wont claim responsibility.

hell, the bastard might even be innocent.

Nevertheless, police said Excel officials fired Smith and contacted police the following week after a search of his laptop found pornographic photos of children that appeared to have been e-mailed to others.

Police seized the computer, as well as disks containing child pornography and a folder with 65 pages of printed pictures of child pornography that Exel officials had found in Smith's desk, the report stated.

i'd stil wait until the search of hist home. not even to mak a conclusion of guiltor innocence, but rather aquittal or conviction.

While I am all for innocent until proven guilty, I wouldn't count on it

This brings up a related issue. Most people here hate child porn for the abhorent obscenity it is - not because nude children are obscene, but because it usually harms children either in its production or the fact that sometimes it is used to seduce children (so is regular "adult" porn).

However, in the online world today it is quite possible to inadvertantly download child porn, even to have it on your computer with you know it is there (I doubt this is the case for this particular person). I have heard of at least one case (in New York IIRC) where someone's brother downloaded and shared child porn using his computer and his ISP account. The guy didn't know it was on his computer, but he got sent to prison for it, and there he languishes even though his brother subsequently confessed (after his brother was convicted and interned).

I frequently view porn various places on the internet, and I have seen child porn on various newsgroups where it is hard to miss it. Temporary images or images mistakenly downloaded containing child porn can land you in hot water. So be careful. Keep in mind that even after you erase a file it is still present on your hard disk and can be retrieved by very simple means (one computer forensics guy retrieved 90,000 porn images in a divorce case).

1) Always check your downloads by viewing each and every thumbnail or full sized image. Delete any questionable images, and then empty your recycle bin and run a wipe disk utility which will overwrite the file.

2) Always know what is going on with your computer if someone else is using it.

Someone should do a study to see if there really is a higher percentage of pedophiles who are religious leaders than should be the norm.
