Legal question about arrest.

I have a question about what may happen next with a friend of mine that apparently was just arrested while he was talking on the phone with me.

His wife (they have been cohabitating for months and are about to divorce) has filed domestic abuse charges against him that I believe are false.

She did not call the police at the time of the alleged incident. She waited until morning, and went to the police department to file a report, versus having the police come to the scene.

Tonight while we were on the phone, he asked me to "hold on" and then I heard what sounded like police radios, mens voices, and then silence.

I am very upset and wonder what happens next? He is hundreds of miles away from me, and this is very hard. He has no prior criminal record and there is no proof of any attack or damage.

I am not asking for legal advice. I am feeling helpless, and have no way of knowing what is going on, or what to think. I know nothing about legal process.

You manage to sound like you know a lot about the situation, so why not start by calling the house and asking the cohabit-lady what's up?

He already has a lawyer. Everyone has advised him to leave the home because of her recent bizarre behavior, we had a feeling this was coming next. He just talked to his lawyer this afternoon before this happened, and his lawyer told him DO NOT LEAVE YOUR HOME. As soon as he got home tonight, he called me to update me, and then put me on hold and I cannot reach him anymore.
I really think he has been arrested. I don't understand how he can be arrested with no proof, is it possible that he is only being questioned?


And yes, I know what happened last night, he called me in the middle of the night to tell me about it. I am convinced that he has never abused her, I have no worries with regard to that.

A lawyer's opinions are her (or his) stock in trade. You cannot expect them to give them freely, but you do not want the opinions of those who know less (and/or are not legally liable for being boneheads.)

They can arrest just because a cop is in a pissy mood, if the prosecutor does anything about is a dif story. If it’s a good or bad arrest doesn’t really change sitting in jail.
You may want to call the local police office and see what his status is. They don't have to give him a call so his lawyer or bondsman might not know yet. I don't know anything about law. This may not even be the way its supposed to work, but that’s how it did where my dear "hubby" was a cop. Good luck.
 
First of all, you don't actually know (based on what you've posted here..) that he actually was arrested or, if he was, on what charges. His "wife" may have filed her statement and when they ran his name through the NCS there may have been 50 warrants for his arrest on entirely unrelated charges. You say that there is no proof. Prisons are filled with people who claim there is no proof. Maybe there is.. Maybe there isn't.

You state that he has a lawyer. I'll assume he's smart enough to use his one phone call to contact that lawyer. In the mean time, while I can understand you being concerned, you aren't going to get info on what is going on. You just need to accept that, breath a little bit and wait. It sucks but it is what it is...
