St. Paul man accused of videotaping murder he committed
Tony Kennedy, Star Tribune

Published April 8, 2003 BAIL08

A St. Paul man who was caught by police while moving the body of his male sex partner took pleasure in his partner's death during a videotaped, sadomasochistic encounter, a prosecutor said Monday at the suspect's murder trial.

However, in his opening statement, a defense attorney for Steven Howard Bailey said that Bailey was on the phone in another room when his alleged victim accidentally or intentionally killed himself. Bailey was so distraught that he attempted suicide by overdosing on pills, defense attorney Bruce Wenger said.

Wenger said Bailey, 54, waived his right to a jury trial and will testify before Ramsey County District Judge George Stephenson.

Wenger said the defense team opted against a jury of "12 unknowns" in favor of Stephenson, whom the team considers a known, fair commodity by himself.

"You wonder how a jury would react," Wenger said.

The trial in downtown St. Paul is expected to last more than a week. Bailey is accused of third-degree murder and second-degree manslaughter in the death last November of Maceo F. Brodnax, 53, of North Hollywood, Calif.

Ramsey County prosecutor Margaret Galvin said that Brodnax died of asphyxia and chloroform poisoning and that Bailey kept him in the apartment for three days before trying to dispose of the body. When two St. Paul police officers caught Bailey loading Brodnax's body into a car at 3 a.m. on Nov. 6, Bailey told them he had killed Brodnax in self-defense by striking him in the head with an ashtray.

The two men had found each other over the Internet, and Brodnax flew to St. Paul to be Bailey's submissive sex partner for two days, Galvin told the judge. She said that Bailey referred to himself as "the true master" in his e-mail messages and that he videotaped his sexual activity with Brodnax.

The prosecutor said Bailey enjoyed fetish videos and "now he had a video for real."

Galvin said Bailey gave a true confession to investigators after a medical examiner found no indication of a head injury to Brodnax. The true confession, she said, was that Bailey tied up Brodnax in his bedroom and ignored him after fitting him with a gas mask, plastic bag and chloroform-soaked rag.

Brodnax died, she said, while Bailey was in the next room having telephone sex with another person. Bailey's "wanton disregard" for his vulnerable sex partner resulted in his death, Galvin said.

But Wenger disputed that account, saying that Brodnax killed himself during masturbation in the bedroom while restricting his own breathing. Bailey was in another room, on the telephone, Wenger said.

"Why Mr. Brodnax would do this is anybody's guess," Wenger told the judge. "Was he trying to take his own life?"

Wenger said Bailey erred by failing to call for emergency help, by keeping the body in his apartment for three days and by lying to police.

"He is guilty of false information to police," Wenger said.

During a recess Monday, Galvin estimated that it would take all week to present the prosecution's case. Wenger estimated that it would be next week before Bailey takes the witness stand.

OK, what does this have to do with BDSM, exactly?

Did you bother to read the story?

Let me quote a portion of it since reading the entire story seems to be beyond your capabilities:

The two men had found each other over the Internet, and Brodnax flew to St. Paul to be Bailey's submissive sex partner for two days, Galvin told the judge. She said that Bailey referred to himself as "the true master" in his e-mail messages and that he videotaped his sexual activity with Brodnax.

No, maybe somehow my simple post was too cerebral for you. What does that have to do SPECIFICALLY with BDSM, in a way that ONLY BDSM would have led to it?

You act as though 'nilla people never do stupid things.

If said person hadn't been playing with fire in the first place, said person would not have been burned.

Is that simple enough for you?

That still doesn't mean alot, in a BDSM context. If a woman accidentally bites of her husband's penis while giving him a blowjob while driving and they get a flat, would you condemn all oral sex, or driving?

A fine example of stupidity in the extreme:

What did these guys do wrong?

Obviously, the victim did not have a system for a safe call.
Apparently, no one knew where he was when he wasn't heard from for a few days.
And consent? In either situation protrayed, SSC was certainly not part of the play.
I doubt references were obtained or criminal record checks were completed.

No one, BDSM or not, should EVER meet someone from on line without certain safety protocols in place.

No matter how "safe" you feel with someone on the phone or on line, a responsible new "friend" of any kind, will respect your safety interventions and should have the same set up for him or herself.

If anyone wants some idea concerning safety mechanisms and identifying predatorial behavior, feel free to click on the link in the sticky. The article isn't a great one as it is gender biased, but translating the info across the masses, one gets a feel for what to look for.

Thanks, Miss T.
Always around with the useful comments, aren't you?

Yeah, I would have to say that this was so much more stupidity than anything else...probably people who thought they were into BDSM, without doing any research.

While I certainly feel sorry for Mr. Brodnax, I also have to state that neither man acted responsibly.

As far as I can see, this relates to a healthy BDSM relationship as much as Lorena Bobbitt's actions related to a healthy handling of her husband's infidelities.

Well, unless you feel that Lorena Bobbitt harbored BDSM fantasies?

Your preaching is old, lance. And you are preaching to the wrong people. What is your schtick? "If I can convince one person to leave BDSM I will have accomplished my mission." Is that your motto or creed? Give it up, dude.

Plenty of guys kill each other in looking for Mr. Goodbar gone awry scenarios. So do hets. So do lesbians. Any time 2 people decide to get it on with total strangers the result can be ecstatic fun or a nightmare come true.

People are willing to take on the risk for a sexual thrill or just a thrill.

I don't think this is a BDSM related phenomenon, just very sad when someone vulnerable meets someone psychotic.

And when it is good, it is very very good. Otherwise no one would bother.

bad wiring?

So anyone who takes risks for a thrill is a victim of bad wiring?

I'd say that most SM between people who know one another is comparable to riding your average well-maintained roller coaster.

This case, while local to me, and very sad, is hardly represenative of SM gone wrong, or even homosexuality gone wrong, another viewpoint I am sure people will try to preach moarlity from. It's a tragic and unfortunate thing, period.

Using it to further an agenda is, to me, another kind of criminality.

Insanity can thread itself anywhere. Nothing is immune to sex crimes. This guy had an agenda and a loose screw. The reality is that shit like this can happen at any time, under multiple circumstances.

I’m a top, always in control, however I make it a point to spend time really getting to know bottoms. I watch them, test them and really investigate their personalities to see if they show signs of insanity or emotional imbalance.

I was a pro-domme for a number of years and encounter a few touchy situations. I remember that I once had been in contact with a man for approximately 6 months, via the phone, email, chat, etc. I agree to let him come for a visit. I won’t go into details, but I sensed that something was right. I’m always safe; I thoroughly check people out and had a back up plan. Fortunately I was able to get him to leave without too much trouble.

I believe in following my gut feeling. If it doesn’t feel right, for any reason, I quietly decline.

I was making my point in the topic line. You could use this article to prove that a number of activities are risky, including homosexuality which lancymayon seems to have no objection too. (Although he should check what his bible says about that)
