St. Paul man accused of videotaping murder he committed

A St. Paul man who was caught by police while moving the body of his male sex partner took pleasure in his partner's death during a videotaped, sadomasochistic encounter, a prosecutor said Monday at the suspect's murder trial.
However, in his opening statement, a defense attorney for Steven Howard Bailey said that Bailey was on the phone in another room when his alleged victim accidentally or intentionally killed himself. Bailey was so distraught that he attempted suicide by overdosing on pills, defense attorney Bruce Wenger said.
Wenger said Bailey, 54, waived his right to a jury trial and will testify before Ramsey County District Judge George Stephenson.
Wenger said the defense team opted against a jury of "12 unknowns" in favor of Stephenson, whom the team considers a known, fair commodity by himself.
"You wonder how a jury would react," Wenger said.
The trial in downtown St. Paul is expected to last more than a week. Bailey is accused of third-degree murder and second-degree manslaughter in the death last November of Maceo F. Brodnax, 53, of North Hollywood, Calif.
Ramsey County prosecutor Margaret Galvin said that Brodnax died of asphyxia and chloroform poisoning and that Bailey kept him in the apartment for three days before trying to dispose of the body. When two St. Paul police officers caught Bailey loading Brodnax's body into a car at 3 a.m. on Nov. 6, Bailey told them he had killed Brodnax in self-defense by striking him in the head with an ashtray.
The two men had found each other over the Internet, and Brodnax flew to St. Paul to be Bailey's submissive sex partner for two days, Galvin told the judge. She said that Bailey referred to himself as "the true master" in his e-mail messages and that he videotaped his sexual activity with Brodnax.
The prosecutor said Bailey enjoyed fetish videos and "now he had a video for real."
Galvin said Bailey gave a true confession to investigators after a medical examiner found no indication of a head injury to Brodnax. The true confession, she said, was that Bailey tied up Brodnax in his bedroom and ignored him after fitting him with a gas mask, plastic bag and chloroform-soaked rag.
Brodnax died, she said, while Bailey was in the next room having telephone sex with another person. Bailey's "wanton disregard" for his vulnerable sex partner resulted in his death, Galvin said.
But Wenger disputed that account, saying that Brodnax killed himself during masturbation in the bedroom while restricting his own breathing. Bailey was in another room, on the telephone, Wenger said.
"Why Mr. Brodnax would do this is anybody's guess," Wenger told the judge. "Was he trying to take his own life?"
Wenger said Bailey erred by failing to call for emergency help, by keeping the body in his apartment for three days and by lying to police.
"He is guilty of false information to police," Wenger said.
During a recess Monday, Galvin estimated that it would take all week to present the prosecution's case. Wenger estimated that it would be next week before Bailey takes the witness stand.
