Somebody must have been thinking of me, the past couple of weeks. I've actually got some good news to pass on!

First off, I want to say I appreciate any good wishes that have been offered to me, in this thread and good thoughts that have been sent my way in prayers or any other ways. I've had it pretty rough these last couple of months, but I'm still getting by.

Unfortunately, I'm putting as much as possible on my credit cards, and that only works as a temporary fix. I'm not looking forward to what might happen, if I never get a job and end up filing bankruptcy. No, I haven't had to do that, yet. I've been lucky to have a good friend loan me $500 and my sister has also loaned me $400 so I'm good until at least the end of May, financially. Sure, the credit cards are getting the bulk of it, but I'm not up to my limit, yet.

On the unemployment scene, I have found out a lot more than I knew the last time I posted anything. I think I did say that because so many people are unemployed, the unemployment office is running about 4 to 5 weeks behind with everything. My initial claim wasn't even seen by anybody until 4 weeks after I filed.

The bad part about that was I had no money coming in for that period of time. I don't know what other people do, but I haven't had a good night's sleep since all of this crap started. With all of the unemployed people out there, you'd think the state could hire a few of them, even as temp status to get to these claims sooner. I really don't understand that. People are literally begging for jobs and the sole source of their income is delayed because the unemployment office is swamped with paperwork.

Anyway, here's where the whole thing gets convoluted, so stick with me while I try to explain. I didn't officially look for work with enough employers the first week I filed. I only said I applied with two employers and I was required to apply with three. I knew the rules were that I could be denied benefits, but I thought my situation would override that. And I didn't want to lie and ruin my whole claim, so I said I only applied for 2 jobs, instead of the required 3.

Towards the end of the third week, I received the letter that I had been denied benefits for that first week. I was allowed to appeal it, but I didn't see any need. By that time I had already filed for several weeks and once benefits started coming in, I would get several weeks all at once. That first week wouldn't really be worth the hassle of an appeal.

After a few weeks of filing my weekly claim, I noticed I wasn't seeing any direct deposits into my bank account and I needed to know what was going on. Because they prefer you do everything on line, I was able to view my claim status at any time, so I decided to check my claim status to see what the issue was.

I noticed all benefits were "pending" due to a review of some sort. I called and asked what the issue was and found out that my initial claim hadn't come up yet, and it probably would be viewed sometime that week or the next. That's why the pending status was there. I asked what the hold up was and she said they were just backed up because so many people were unemployed.

I asked if there was anything I could do to speed things up and she said that if I thought my former employer was going to fight my unemployment benefits, I could send in a letter to appeal it. She said any appeal letters would be put into my file and only used when an appeal was necessary. I knew my employer would fight my claim, so I sent in a letter of appeal.

I sent a letter of appeal in that next day, which was nearly 4 weeks after I'd been fired. I think it was the first week in March, and I had been fired the second week of February. But, something the person I talked to didn't know and I didn't tell her was that I had received the denial letter for the first week.

A couple more weeks went by and I got 3 letters in the mail from the unemployment people. One was telling me I needed to go to the Career Center every 4 weeks, while filing my claims or I could be denied benefits for that week. The next letter said I could go back to school while I was receiving benefits.

That last letter was the one that caught my attention. It said I had been denied benefits because my former employer had discharged me for saying racial comments and racial jokes which were both against company policy.

Now let's stop and make sense of where we are. I had sent in my appeal letter a few weeks before and this day I got those 3 letters. To me, the third letter pretty much told the story. I had been denied benefits and the unemployment people had agreed with my employer. That's what I understood when I read that letter.

I had sent that appeal letter in a couple weeks before, and so I assumed it had been read and I was still being denied benefits. So, why would I want to go back to school, if I wasn't getting any benefits? And why would I need to go to their stupid career center, either? If I wasn't going to get any benefits, why spend the gas money? I'd been without any kind of income for over a month.

It was quite a drive to the nearest center, because I had worked and filed in another state. I didn't have any money for gas, so I blew everything off and thought the end was near. Money was getting very short and I thought bankruptcy was the next thing in my future.

I looked on line at my claim status and it said I was denied benefits because I had been discharged. Everything was all adding up and not in a good way. Then a week later, I got 2 more letters. One letter said I had been denied benefits for the week I was suppose to go to the career center. I kind of laughed...as if they thought I was going to waste my time and money on a trip to that place.

But, the second letter was a letter telling me they had received my appeal and that a hearing would be scheduled. The letter went on to day I would be sent another letter telling me the time and date of the appeal hearing. I couldn't believe it. I also didn't understand it. Had they just viewed my appeal that I had sent about a month ago?

I thought for a minute and then it hit me. Not only was the initial claim 4 weeks late, but it seemed that everything done at that office was around 3 or 4 weeks late. So, I'd been unemployed for close to 2 whole months and no money coming in. I was hurting.

But, I had a letter saying they had received my appeal. All I had to do was wait for the letter telling me when the hearing would be. But, it seems that was also delayed. It was another couple of weeks before I got that letter and when I got it, it told me that in about 2 weeks, I was granted a telephone hearing to appeal the first week of benefits that I had been denied.

I didn't want to appeal that, and I knew I couldn't win that appeal, anyway. I called again and talked to someone who verified that yes, that appeal hearing would be for the initial first week of benefits. I asked if I still had time to appeal the discharge status and she said I did, if I faxed it in. I said I don't have a fax machine. She said the career centers had fax machines I could use for free. She also said I could clear up the career center visit denial with the same visit.

So, that's what I did. It will be a week ago today that I faxed the appeal of my discharge from the employer. So, I'm waiting for a letter telling me my appeal has been received. I don't expect it for at least another week or so. Then, I'm sure that hearing will be another couple of weeks after that. So, I still have a chance of getting unemployment benefits. Sure, it's been a very long time to wait, but as long as I continue to claim each week, if and when I'm approved, all of that money will come in at once. At this writing, that will be about $2,300, give or take some.

And while I wait, I still have no money coming in. My credit cards are totaling up. Fortunately, my friend and sister have been life savers with their loans or I would have been filing bankruptcy long ago. I hope this part of my ordeal isn't too confusing. And I hope I got all of the weeks correctly. I've been messing with this for a while now, and it's all starting to run together as a big mess.

And there is more good news, too. today, I've actually been called for two interviews. One interview is a national retail store and I don't expect much of an income with them. I even think it might be seasonal work, because the job is a Lawn and Garden sales associate. More than likely it will be a little more than minimum wage.

But, the other interview is with a company that does research for the government. I'd be working in security there, and if I get that job, I'd be paid quite well. I'd make over $5,000 more a year than my previous job and the benefits would be quite good, too. Also, there is a good chance there of advancement into a computer job down the road, which would mean even more money.

No, the job isn't mine but I do have a good resume and both of my previous supervisors said they will give me good references. And the client I have talked about in previous posts said he would also give me a good reference. They all know the situation was fixed against me. In fact, the client said he knew I had been railroaded.

Also, the person that filed the claim against me with the EEOC has been removed from the post. The client said when he found out what had happened, he watched the cameras, waiting for this guy to do something he shouldn't have been doing. He laughed and said he didn't have to wait long.

My former employer doesn't like to pay unemployment and I'm also sure they were afraid this guy would go to the EEOC if he was fired, so they just moved him to another account. That is typical with that company. In some cases, they move you to a spot that isn't very nice and just wait for you to quit.

Another guy who may have been mixed up in the deal was a guy I was trying to catch sleeping on the job. I guess he was finally caught by someone sleeping and resigned the next day. So, there is only one person left on that shift that said I was a racist, and he's white. The two African Americans are both gone. So, unless the company has something pretty substantial against me with this racist thing, it seems pretty likely that their side of the complaint doesn't look so good any more.

So, although I'm very, VERY low on cash, and none yet coming in, there is still light at the end of this nasty, racist tunnel. I'm down, but I'm not out. I can only hope for the best with one of these interviews and keep my fingers crossed. I hope you all will keep your fingers crossed too, and wish me luck with everything that is going on.

I don't expect another letter from the unemployment people for at least another week, maybe two. I hope I have a job by then, but I still have to go through with the appeal process and the hearing if I expect to get any money for these past 2 months I haven't worked.

And, I don't want to jinx it, because my luck isn't the best luck in the world. In fact, I usually have more bad luck than good. I could go into several things that have not gone my way in these last 2 months, but I've gotten use to the phrase "life sucks and then you die".

But when I got 2 calls for interviews today, my life changed a little for the better and I might actually have a job in the next couple of weeks. That would be a very nice birthday present!! :D

WOW, just wow. I'm sorry unemployment has been screwing you over! I think it's not intentional, but unfortunately it is hurtful. I also hope you get that job that will pay $5k more than the last one!

I get this all the time on bdsm forums thanks to the fact I challenge the ethics of casual 'bdsm'.

Far too many people are willing to engage in deceit if it will get them what they want.

Unfortunately trends like this only get worse. Seeing how they profit from deceit, and how there is no down-side for them when they lie, they are only encouraged to do so again, and others learning from their examples will join in.

Things will only get worse.

It would appear there are a few who believe such tactics as name-calling will impress the most mature amongst us.

Either that, or they've resigned themselves to trying to impress the least mature.

That will be the absolute key here. Finding an employer who will be willing to look past what happened, and look at *you* and what you can offer them, rather than dismissing you as a potential liability in the making.

I partially agree with the bold part of your post. Those who find it easy to profit from their deceit do tend to continue. And they often brag about their good fortune to friends who sometimes try it themselves, when the need seems to arise. I know those who used this method against me had been rehearsed by someone in what to say to the EEOC. One day we were all friendly and then all of the sudden, I was an enemy.

But, I live with the hope that someday they'll try their little racist claims once too often. I know that those who gain from ventures such as false EEOC claims will eventually be seen as the opportunistic wolf criers they are. They have a limited number of times they can claim job related racism before they're finally labeled the racist themselves. And it's the good and honest African Americans out there who will suffer in the long run.

But yes, you are correct in saying others will always be willing to try it. Is it racist for me to say "monkey see, monkey do"?
