Todays high court overturned a ruling where an earlier high court overreached its authority, creating a right that never existed under our constitution. Activist judges acted as legislators taking that authority out of the hands of real legislative bodies ( the house and senate) Stare decisis does not justify allowing the incorrect interpretation of the constitution and protect a bad law. The supreme court exist to interpret and apply the constitution not create its own legal principles.
