How to get a plagiarised story removed?

Does anyone know the best way to go about having plagiarised work removed from the site? I reported the story with a link to my original submission. I also sent a message to the member asking her to request its deletion but it hasn't been removed as yet. It's quite frustrating to see someone claim my work as their own. I've also been receiving a few emails letting me know it's been copied so I'd really like to see it gone.

If anyone has any suggestions I'd appreciate the advice. (Maybe a large number of stories are reported each day and it takes a while to work through them.)

I cannot give an answer to your direct question as to how to get this story removed, but I can tell you that this is not plagiarism, it is direct and flagrant breach of copyright, which is a criminal offence in most jurisdictions. None of the possible defences under copyright law apply here. This is word for word copying. It is not just the author who is in breach of copyright, it is also the publisher, which in this case is Literotica.com. You must point this out to them and insist that they rectify the situation immediately.

The fact that it is on the internet is neither here nor there. Nor is the fact that you are not being paid for the work.

PM Laurel. Oris she Lauren mibbe? She'll sort it and remove her/him from Lit. I did this for my beloved Ozzie ex, and the stolen story was gone the next day.
 
I don't like plagerized work but you people take yourselves waaay to seriously here. There is no such thing as copyrighted work unless you have copyrighted your work by sending it into a copyright office and have it officially copyrighted, similar to getting a patent for an invention. You can't just post something on Literotica and it is officially copyrighted. On top of that, even if it were legally copyrighted you would not have much legal recourse unless you could prove damages, meaning that someone made money off plagerizning your copyrighted work. In any event, I hope it has already been removed.

Wrong - all it takes is proof of authorship. That can even be the creation date of an original draft. There are various methods - but formal registration is not required.

What is true in the US is not true in most of the world. In the UK and most of Europe I have copyright from the moment my fingers leave the keys. I don't need to register that copyright, nor pay for such registration.

However, as in the US, even if I have copyright, I cannot enforce that right without paying for expensive lawyers. If the person abusing my copyright has no or few assets, the prospects of recovering legal costs or getting damages is minimal, even if a court would give ANY damages for abusing copyright for something posted on a FREE site.

If you look at every story posted on Literotica, it has the copyright symbol. On most of my stories I have a copyright notice as well.

If I want to find my stories widely scattered around the net, all I have to do is Google 'copyright oggbashan' and find dozens of breaches of my copyright.

When you post it here, you give it away pure and simple.

But for the record you don't have to "send" an online story or e-book to the copyright office. You can apply online for a digital copyright for $35 and they send you the copyrigft 6 weeks later in the mail. You can do an entire series under one copyright to save money.

This is good to know, seeing as how I've got 4 series which I plan on writing in the next few years.

So I don't have copyright in the US, which historically has been the home of the worst copyright thieves in the world. Charles Dickens, Conan Doyle, Rudyard Kipling, and Gilbert and Sullivan all suffered massive losses because of US based copyright theft, and had no real redress from US courts.

Now SE Asia is the worst area for copyright theft. Many websites that steal copyright stories, videos and pictures are based there, beyond reach.

Not so. In simple terms regarding the OP's position here. Her work is automatically protected by copyright upon its creation. It DOES NOT need to be registered anywhere by anyone. It was her creation and then copied/used with out her permission.
I have spent many years in several Photography sites and questions like this come up fairly often. In this case I doubt the OP would get any monetary compensation from it. How ever for example if a magazine/website uses someones article or photo with out permission of the author then they could demand fair compensation. Which would be what a person of his peers would be typically and fairly compensated for the use of said production. If there is any profit that can be proven too then they would be entitled to any profits as well.

For the context of this forum. It would be sufficient to have the forum operators/moderator remove the copied item with a warning given to the offender. I have seen a couple times where some one had proved that the article in question was theirs and it was refused to be removed. Threatened legal action and the ISP actually shut down the website.

As mentioned, the answer is to PM Lauren and she'll take down the copied story.

It happened to me once. The funny thing is that the person who copied got a higher score than I did. :eek:

A number of readers did notice that it was a copy and pointed it out in the comments though.
