House guests

Hi, I have looked online, but been able to find little on my rights as an appartment dweller...

I rent a two bedroom from a friend, but we don't really consider it renting, I am allowed to live here as long as I help with expences and some labor around the house. there is no lease agreement, or rental agreement.

I have allowed a friend to stay with me for some time, and have been informed by the police that if he is living here, then I need to give 30 days notice to evict. that's all fine and honestly I feel no need to evict him, but I would like to know what my rights are as far as the appartment goes. I am the official dweller here, and he is simply my long term guest, I give him the same agreement that I have and my agreeement is not contingent upon his presence.

I have known lit to be home to some of the wittiest and most intelligent people I know. help me Identify my somewhat unique situation, and help me understand the guidlines of what I've gotten myself into...

The lease agreement you have with your homeowner friend is one of reason and maturity. I commend you on having relationships that you can operate on a handshake. As long as you and your guest remain reasonable and mature, there's no reason to be concerned, should the need arise for the guest to leave. However, the law doesn't see things quite so reasonably and mature. The law works on contracts, signed agreements, etc. If you wanted to be a bug-a-boo and NOT leave when your welcome was worn out, your homeowner friend would find it difficult to get you out. Likewise with your guest, though the problem would be less yours than the landlords.
 
I'm not a lawyer but just reciently had a friend who was in a simular arraingement. When the friend would no longer contribue fro the rent the cops were called and took him away. No 30 days no nothing he had no rights and away he went.

Well the part that sticks out to me is the if part. Did you tell him he was a guest or did you ever refer to him as a room mate? If not you should be able to tell him to get out any moment you please. The court is going to look for papers. If you dont let the judge know you made a verbal contract then he is out of luck.

Laws of renting places to people change from state to state. In ny if i were to rent a place and told someone they could move in as a room mate.(which by law they would be my tentant (sp?) Then that person totaled the place and refused to fix it. I would be the one sued by the owner. Then i would have to sue the room mate to get my money back.
